55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an emergency rule adopted by a state agency during
88 certain periods of disaster.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2001.034, Government Code, is amended by
1111 amending Subsection (c) and adding Subsection (c-1) to read as
1212 follows:
1313 (c) Except as provided by Subsection (c-1), a [A] rule
1414 adopted under this section may be effective for not longer than 120
1515 days and may be renewed once for not longer than 60 days. An
1616 identical rule may be adopted under Sections 2001.023 and 2001.029.
1717 (c-1) This subsection applies only to an emergency rule
1818 adopted during a period in which at least 75 percent of the counties
1919 in this state are declared to be in a state of disaster or emergency
2020 by the governor. An emergency rule to which this subsection applies
2121 may be effective for not longer than 30 days and may be renewed for
2222 not longer than 60 days. The renewal must be approved by majority
2323 vote at a joint hearing of the standing committees of each house of
2424 the legislature with primary jurisdiction over the state agency
2525 seeking to renew the emergency rule.
2626 SECTION 2. Section 2001.034(c-1), Government Code, as added
2727 by this Act, applies only to an emergency rule that is adopted by a
2828 state agency on or after the effective date of this Act.
2929 SECTION 3. This Act takes effect September 1, 2021.
