7 | 7 | | relating to an emergency rule adopted by a state agency during |

8 | 8 | | certain periods of disaster. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 2001.034, Government Code, is amended by |
---|
11 | 11 | | amending Subsection (c) and adding Subsection (c-1) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (c) Except as provided by Subsection (c-1), a [A] rule |
---|
14 | 14 | | adopted under this section may be effective for not longer than 120 |
---|
15 | 15 | | days and may be renewed once for not longer than 60 days. An |
---|
16 | 16 | | identical rule may be adopted under Sections 2001.023 and 2001.029. |
---|
17 | 17 | | (c-1) This subsection applies only to an emergency rule |
---|
18 | 18 | | adopted during a period in which at least 75 percent of the counties |
---|
19 | 19 | | in this state are declared to be in a state of disaster or emergency |
---|
20 | 20 | | by the governor. An emergency rule to which this subsection applies |
---|
21 | 21 | | may be effective for not longer than 30 days and may be renewed for |
---|
22 | 22 | | not longer than 60 days. The renewal must be approved by majority |
---|
23 | 23 | | vote at a joint hearing of the standing committees of each house of |
---|
24 | 24 | | the legislature with primary jurisdiction over the state agency |
---|
25 | 25 | | seeking to renew the emergency rule. |
---|
26 | 26 | | SECTION 2. Section 2001.034(c-1), Government Code, as added |
---|
27 | 27 | | by this Act, applies only to an emergency rule that is adopted by a |
---|
28 | 28 | | state agency on or after the effective date of this Act. |
---|
29 | 29 | | SECTION 3. This Act takes effect September 1, 2021. |
