| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 3, Government Code, is amended |
|---|
| 11 | 11 | | by adding Chapter 315A to read as follows: |
|---|
| 12 | 12 | | CHAPTER 315A. CHILDHOOD RACIAL DISPARITY IMPACT STATEMENT |
|---|
| 13 | 13 | | Sec. 315A.001. DEFINITION. In this chapter, "state agency" |
|---|
| 14 | 14 | | has the meaning assigned by Section 315.002. |
|---|
| 15 | 15 | | Sec. 315A.002. CHILDHOOD RACIAL DISPARITY IMPACT |
|---|
| 16 | 16 | | STATEMENT. (a) At the request of the lieutenant governor or |
|---|
| 17 | 17 | | speaker of the house of representatives, a state agency shall |
|---|
| 18 | 18 | | prepare a childhood racial disparity impact statement for any bill |
|---|
| 19 | 19 | | or joint resolution pending before the legislature that directly |
|---|
| 20 | 20 | | affects that agency. Preparation of the statement shall be |
|---|
| 21 | 21 | | coordinated through the director of the Legislative Budget Board. |
|---|
| 22 | 22 | | (b) A childhood racial disparity impact statement must |
|---|
| 23 | 23 | | include: |
|---|
| 24 | 24 | | (1) a brief description of the nature and effect of the |
|---|
| 25 | 25 | | proposal; and |
|---|
| 26 | 26 | | (2) a statement of the manner and extent to which the |
|---|
| 27 | 27 | | proposal, if implemented, will directly or indirectly during each |
|---|
| 28 | 28 | | of the two years following its effective date: |
|---|
| 29 | 29 | | (A) increase or decrease racial disparities |
|---|
| 30 | 30 | | among children under the age of 18 in the state, including the |
|---|
| 31 | 31 | | number of children affected and the geographic area affected; |
|---|
| 32 | 32 | | (B) affect the manner in which local governments |
|---|
| 33 | 33 | | operate that may result in an increase or decrease in childhood |
|---|
| 34 | 34 | | racial disparities; and |
|---|
| 35 | 35 | | (C) impact childhood racial disparities in the |
|---|
| 36 | 36 | | state other than those specifically described by this subdivision. |
|---|
| 37 | 37 | | (c) A childhood racial disparity impact statement that |
|---|
| 38 | 38 | | omits information required by this section must: |
|---|
| 39 | 39 | | (1) specifically note the omission; |
|---|
| 40 | 40 | | (2) state the reason for the omission; and |
|---|
| 41 | 41 | | (3) estimate the additional time and effort required |
|---|
| 42 | 42 | | to obtain the information. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2021. |
