66 AN ACT
77 relating to statements on the impact of legislation on childhood
88 racial disparity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 3, Government Code, is amended
1111 by adding Chapter 315A to read as follows:
1212 CHAPTER 315A. CHILDHOOD RACIAL DISPARITY IMPACT STATEMENT
1313 Sec. 315A.001. DEFINITION. In this chapter, "state agency"
1414 has the meaning assigned by Section 315.002.
1515 Sec. 315A.002. CHILDHOOD RACIAL DISPARITY IMPACT
1616 STATEMENT. (a) At the request of the lieutenant governor or
1717 speaker of the house of representatives, a state agency shall
1818 prepare a childhood racial disparity impact statement for any bill
1919 or joint resolution pending before the legislature that directly
2020 affects that agency. Preparation of the statement shall be
2121 coordinated through the director of the Legislative Budget Board.
2222 (b) A childhood racial disparity impact statement must
2323 include:
2424 (1) a brief description of the nature and effect of the
2525 proposal; and
2626 (2) a statement of the manner and extent to which the
2727 proposal, if implemented, will directly or indirectly during each
2828 of the two years following its effective date:
2929 (A) increase or decrease racial disparities
3030 among children under the age of 18 in the state, including the
3131 number of children affected and the geographic area affected;
3232 (B) affect the manner in which local governments
3333 operate that may result in an increase or decrease in childhood
3434 racial disparities; and
3535 (C) impact childhood racial disparities in the
3636 state other than those specifically described by this subdivision.
3737 (c) A childhood racial disparity impact statement that
3838 omits information required by this section must:
3939 (1) specifically note the omission;
4040 (2) state the reason for the omission; and
4141 (3) estimate the additional time and effort required
4242 to obtain the information.
4343 SECTION 2. This Act takes effect September 1, 2021.
