66 AN ACT
77 relating to the establishment of a border public health initiative
88 by the Department of State Health Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 65 to read as follows:
1212 CHAPTER 65. BORDER PUBLIC HEALTH INITIATIVE
1313 Sec. 65.0001. DEFINITIONS. In this chapter:
1414 (1) "Border county" means a county adjacent to this
1515 state's international border with Mexico.
1616 (2) "Promotora" or "community health worker" has the
1717 meaning assigned by Section 48.001.
1818 Sec. 65.0002. BORDER PUBLIC HEALTH INITIATIVE. (a) The
1919 department shall develop an initiative to reduce the adverse health
2020 impacts of diabetes, hypertension, and obesity for adults and
2121 children in border counties. The initiative must promote:
2222 (1) educational resources designed to prevent those
2323 conditions;
2424 (2) screenings of persons at risk for those
2525 conditions; and
2626 (3) referrals to and treatment by health care
2727 providers for those conditions.
2828 (b) In developing the border public health initiative, the
2929 department may consult and collaborate with:
3030 (1) other health and human services agencies;
3131 (2) other appropriate state or federal agencies;
3232 (3) health science centers and medical schools; and
3333 (4) public and private health care providers and
3434 hospitals.
3535 Sec. 65.0003. OUTREACH CAMPAIGNS. To implement the border
3636 public health initiative described by Section 65.0002, the
3737 department shall conduct bilingual, culturally appropriate
3838 outreach campaigns in consultation and collaboration with
3939 appropriate individuals and entities that may include:
4040 (1) promotoras and community health workers;
4141 (2) academic centers located in border counties;
4242 (3) nonprofit organizations;
4343 (4) public schools;
4444 (5) public and private health care providers and
4545 hospitals;
4646 (6) worksite wellness programs;
4747 (7) local business and health care providers that
4848 provide early detection of prediabetes, prehypertension, and
4949 obesity; and
5050 (8) other local entities, as the department determines
5151 appropriate.
5252 Sec. 65.0004. REPORT. Not later than January 1, 2025, the
5353 department shall prepare and electronically submit to the
5454 lieutenant governor, the speaker of the house of representatives,
5555 and the legislature a report describing:
5656 (1) health outcomes and health care savings resulting
5757 from prevention, screenings, and treatment of chronic diseases
5858 under the border public health initiative; and
5959 (2) other relevant findings, as determined by the
6060 department, resulting from the border public health initiative.
6161 Sec. 65.0005. EXPIRATION. This chapter expires December
6262 31, 2033.
6363 SECTION 2. The Department of State Health Services is
6464 required to implement a provision of this Act only if the
6565 legislature appropriates money specifically for that purpose. If
6666 the legislature does not appropriate money specifically for that
6767 purpose, the department may, but is not required to, implement a
6868 provision of this Act using other appropriations available for that
6969 purpose.
7070 SECTION 3. This Act takes effect September 1, 2021.
