66 AN ACT
77 relating to manufacturer disclosure of cosmetic ingredients;
88 authorizing an administrative penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 431, Health and Safety
1111 Code, is amended by adding Section 431.143 to read as follows:
1212 Sec. 431.143. MANUFACTURER DISCLOSURE. (a) A manufacturer
1313 selling a cosmetic in this state shall disclose on the
1414 manufacturer's Internet website:
1515 (1) a list of each ingredient in the cosmetic,
1616 including a fragrance, flavor, and color additive, in order of
1717 predominance except that the ingredients with a concentration of
1818 less than one percent may be listed in any order for purposes of
1919 protecting a trade secret; and
2020 (2) the chemical abstract service number for each
2121 listed ingredient.
2222 (b) A manufacturer is not required to list the concentration
2323 of each ingredient in a cosmetic under Subsection (a).
2424 SECTION 2. Section 431.054(a), Health and Safety Code, is
2525 amended to read as follows:
2626 (a) The department may assess an administrative penalty
2727 against a person who violates Subchapter B, Section 431.143, or an
2828 order adopted or registration issued under this chapter.
2929 SECTION 3. This Act takes effect September 1, 2021.
