76 AN ACT
87 relating to the election of certain unopposed candidates.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 2.053(a), Election Code, is amended to
1110 read as follows:
1211 (a) On receipt of the certification, the governing body of
1312 the political subdivision by order or ordinance shall [may] declare
1413 each unopposed candidate elected to the office. If no election is to
1514 be held on election day by the political subdivision, a copy of the
1615 order or ordinance shall be posted on election day at each polling
1716 place used or that would have been used in the election.
1817 SECTION 2. Section 2.056(c), Election Code, is amended to
1918 read as follows:
2019 (c) A certifying authority shall [may] declare a candidate
2120 elected to an office of the state or county government if, were the
2221 election held, only the votes cast for that candidate in the
2322 election for that office may be counted.
2423 SECTION 3. Section 52.092(a), Election Code, is amended to
2524 read as follows:
2625 (a) Except as provided by Section 2.053(c) or 2.056(e), for
2726 [For] an election at which offices regularly filled at the general
2827 election for state and county officers are to appear on the ballot,
2928 the offices shall be listed in the following order:
3029 (1) offices of the federal government;
3130 (2) offices of the state government:
3231 (A) statewide offices;
3332 (B) district offices;
3433 (3) offices of the county government:
3534 (A) county offices;
3635 (B) precinct offices.
3736 SECTION 4. This Act takes effect September 1, 2021.
