55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation of a public transit motor bus by certain
88 mass transit entities on an improved shoulder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.058(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) A limitation in this section on driving on an improved
1313 shoulder does not apply to:
1414 (1) an authorized emergency vehicle responding to a
1515 call;
1616 (2) a police patrol;
1717 (3) a bicycle; [or]
1818 (4) a slow-moving vehicle, as defined by Section
1919 547.001; or
2020 (5) a public transit motor bus of a mass transit entity
2121 operating under Subtitle K, Title 6, if the motor bus is:
2222 (A) operating within the boundaries of a
2323 metropolitan planning organization in which:
2424 (i) at least five counties are located; and
2525 (ii) the two counties with the largest
2626 populations are part of a regional mobility authority governed by
2727 Chapter 370; and
2828 (B) bypassing traffic on a highway that is under
2929 construction by operating on a shoulder designated by the Texas
3030 Department of Transportation.
3131 SECTION 2. This Act takes effect September 1, 2021.
