10 | 10 | SECTION 1. Chapter 240, Local Government Code, is amended | |
11 | 11 | by adding Subchapter D to read as follows: | |
12 | 12 | SUBCHAPTER D. REGULATION OF NOISE LEVELS IN CERTAIN COUNTIES | |
13 | 13 | Sec. 240.061. AUTHORITY TO REGULATE. To promote public | |
14 | 14 | health, safety, and welfare, the commissioners court of a county | |
15 | 15 | with a population of more than 3.3 million by order may regulate the | |
16 | 16 | level of noise emanating from a residence located in a residential | |
17 | 17 | area in the unincorporated area of the county. | |
18 | 18 | Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an | |
19 | 19 | offense if the person violates an order adopted under this | |
20 | 20 | subchapter. | |
21 | 21 | (b) An offense under this section is a Class C misdemeanor. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2021. |
