66 AN ACT
77 relating to the authority of certain counties to regulate noise
88 levels in residential areas; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 240, Local Government Code, is amended
1111 by adding Subchapter D to read as follows:
1212 SUBCHAPTER D. REGULATION OF NOISE LEVELS IN CERTAIN COUNTIES
1313 Sec. 240.061. AUTHORITY TO REGULATE. To promote public
1414 health, safety, and welfare, the commissioners court of a county
1515 with a population of more than 3.3 million by order may regulate the
1616 level of noise emanating from a residence located in a residential
1717 area in the unincorporated area of the county.
1818 Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an
1919 offense if the person violates an order adopted under this
2020 subchapter.
2121 (b) An offense under this section is a Class C misdemeanor.
2222 SECTION 2. This Act takes effect September 1, 2021.
