4	10		AN ACT
5	11		relating to the establishment of a bone marrow donor recruitment
6	12		program.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
9	15		amended by adding Chapter 53 to read as follows:
10	16		CHAPTER 53. BONE MARROW DONOR RECRUITMENT PROGRAM
11	17		Sec. 53.001. ESTABLISHMENT OF PROGRAM. (a) The department
12	18		shall establish a bone marrow donor recruitment program to educate
13	19		residents of this state about:
14	20		(1) the need for bone marrow donors, including the
15	21		particular need for donors from minority populations;
16	22		(2) the requirements for registering with the
17	23		federally authorized bone marrow donor registry established and
18	24		maintained as required by 42 U.S.C. Section 274k as a potential bone
19	25		marrow donor, including procedures for determining an individual's
20	26		tissue type;
21	27		(3) the medical procedures an individual must undergo
22	28		to donate bone marrow or other sources of blood stem cells; and
23	29		(4) the availability of information about bone marrow
24	30		donation in health care facilities, blood banks, and driver's
25	31		license offices.
26	32		(b) The department, in consultation with the federally
27	33		authorized bone marrow donor registry established and maintained as
28	34		required by 42 U.S.C. Section 274k and the registry's interested
29	35		contracted network partners, shall develop written and electronic
30	36		informational materials, including links to Internet websites and
31	37		machine-readable codes, regarding:
32	38		(1) bone marrow donation; and
33	39		(2) the process of registering with the federally
34	40		authorized bone marrow donor registry.
35	41		(c) The federally authorized bone marrow donor registry, in
36	42		collaboration with the registry's interested contracted network
37	43		partners, may develop and provide the informational materials
38	44		described by Subsection (b) to the department.
39	45		(d) The department and the Department of Public Safety shall
40	46		post the information described by Subsection (b) on each agency's
41	47		respective Internet websites.
42	48		(e) Appropriate health care facilities, blood banks, and
43	49		driver's license offices may access the informational materials
44	50		described by Subsection (b) on the Internet websites of the
45	51		department and the Department of Public Safety and print the
46	52		materials to place in their facilities, banks, or offices to
47	53		provide to residents of this state.
48	54		SECTION 2. As soon as practicable after the effective date
49	55		of this Act, the Department of State Health Services shall
50	56		establish the program and obtain the informational materials as
51	57		required by Section 53.001, Health and Safety Code, as added by this
52	58		Act.
53	59		SECTION 3. This Act takes effect September 1, 2021.
