410 AN ACT
511 relating to the establishment of a bone marrow donor recruitment
612 program.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
915 amended by adding Chapter 53 to read as follows:
1016 CHAPTER 53. BONE MARROW DONOR RECRUITMENT PROGRAM
1117 Sec. 53.001. ESTABLISHMENT OF PROGRAM. (a) The department
1218 shall establish a bone marrow donor recruitment program to educate
1319 residents of this state about:
1420 (1) the need for bone marrow donors, including the
1521 particular need for donors from minority populations;
1622 (2) the requirements for registering with the
1723 federally authorized bone marrow donor registry established and
1824 maintained as required by 42 U.S.C. Section 274k as a potential bone
1925 marrow donor, including procedures for determining an individual's
2026 tissue type;
2127 (3) the medical procedures an individual must undergo
2228 to donate bone marrow or other sources of blood stem cells; and
2329 (4) the availability of information about bone marrow
2430 donation in health care facilities, blood banks, and driver's
2531 license offices.
2632 (b) The department, in consultation with the federally
2733 authorized bone marrow donor registry established and maintained as
2834 required by 42 U.S.C. Section 274k and the registry's interested
2935 contracted network partners, shall develop written and electronic
3036 informational materials, including links to Internet websites and
3137 machine-readable codes, regarding:
3238 (1) bone marrow donation; and
3339 (2) the process of registering with the federally
3440 authorized bone marrow donor registry.
3541 (c) The federally authorized bone marrow donor registry, in
3642 collaboration with the registry's interested contracted network
3743 partners, may develop and provide the informational materials
3844 described by Subsection (b) to the department.
3945 (d) The department and the Department of Public Safety shall
4046 post the information described by Subsection (b) on each agency's
4147 respective Internet websites.
4248 (e) Appropriate health care facilities, blood banks, and
4349 driver's license offices may access the informational materials
4450 described by Subsection (b) on the Internet websites of the
4551 department and the Department of Public Safety and print the
4652 materials to place in their facilities, banks, or offices to
4753 provide to residents of this state.
4854 SECTION 2. As soon as practicable after the effective date
4955 of this Act, the Department of State Health Services shall
5056 establish the program and obtain the informational materials as
5157 required by Section 53.001, Health and Safety Code, as added by this
5258 Act.
5359 SECTION 3. This Act takes effect September 1, 2021.
