7	6		AN ACT
8	7		relating to a public school campus's election under a campus
9	8		turnaround plan to operate as a community school.
10	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	10		SECTION 1. Subchapter C, Chapter 39A, Education Code, is
12	11		amended by adding Section 39A.1011 to read as follows:
13	12		Sec. 39A.1011. CAMPUS TURNAROUND PLAN TO OPERATE AS
14	13		COMMUNITY SCHOOL. (a) A campus turnaround plan may permit a campus
15	14		to operate as a community school. A plan to operate as a community
16	15		school must include, in addition to the other requirements of this
17	16		subchapter, strategies and programs to coordinate academic,
18	17		social, and health services and reduce barriers to learning through
19	18		partnerships and service coordination.
20	19		(b) Programs and services offered by a campus operating as a
21	20		community school under a campus turnaround plan may include:
22	21		(1) early childhood education;
23	22		(2) after-school and summer school academic and
24	23		enrichment programs;
25	24		(3) college and career preparation;
26	25		(4) service learning opportunities, such as
27	26		internships and community service programs;
28	27		(5) leadership and mentoring programs;
29	28		(6) activities to encourage community and parent
30	29		engagement in students' education;
31	30		(7) health and social services for students and their
32	31		families; and
33	32		(8) parenting classes.
34	33		(c) A campus that elects to operate as a community school
35	34		under a campus turnaround plan must:
36	35		(1) establish a school community partnership team,
37	36		composed of the members required for a campus-level planning and
38	37		decision-making committee under Section 11.251 and additional
39	38		community representatives, to coordinate with the campus
40	39		intervention team for the campus;
41	40		(2) establish a partnership with a lead organization
42	41		that has experience in developing and implementing a community
43	42		school plan;
44	43		(3) designate a school district employee or an
45	44		employee of an organization with experience in developing and
46	45		implementing a community school plan as the community school
47	46		coordinator for the campus, whose duties must include the
48	47		recruitment and coordination of services from community partners;
49	48		(4) develop a community school plan that satisfies the
50	49		requirements for a campus improvement plan under Section 11.253;
51	50		and
52	51		(5) obtain approval for the community school plan
53	52		from:
54	53		(A) at least 75 percent of campus faculty and
55	54		staff and 75 percent of parents of students enrolled at the campus;
56	55		and
57	56		(B) the board of trustees of the school district
58	57		in which the campus is located.
59	58		SECTION 2. Section 39A.107, Education Code, is amended by
60	59		adding Subsection (d) to read as follows:
61	60		(d) Notwithstanding Subsection (c), the commissioner may
62	61		not order the closure of a campus under this section without giving
63	62		the campus the opportunity to operate as a community school under a
64	63		campus turnaround plan as provided by Section 39A.1011 and at least
65	64		two years to implement the campus's community school plan.
66	65		SECTION 3. Section 39A.111, Education Code, is amended to
67	66		read as follows:
68	67		Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING.
69	68		(a) If a campus is considered to have an unacceptable performance
70	69		rating for three consecutive school years after the campus is
71	70		ordered to submit a campus turnaround plan under Section 39A.101,
72	71		the commissioner, subject to Section 39A.112, shall order:
73	72		(1) appointment of a board of managers to govern the
74	73		school district as provided by Section 39A.202; or
75	74		(2) closure of the campus.
76	75		(b) Notwithstanding Subsection (a), the commissioner may
77	76		not order the closure of a campus under this section without giving
78	77		the campus the opportunity to operate as a community school under a
79	78		campus turnaround plan as provided by Section 39A.1011 and at least
80	79		two years to implement the campus's community school plan.
81	80		SECTION 4. This Act takes effect immediately if it receives
82	81		a vote of two-thirds of all the members elected to each house, as
83	82		provided by Section 39, Article III, Texas Constitution. If this
84	83		Act does not receive the vote necessary for immediate effect, this
85	84		Act takes effect September 1, 2021.
