65 A BILL TO BE ENTITLED
76 AN ACT
87 relating to a public school campus's election under a campus
98 turnaround plan to operate as a community school.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Subchapter C, Chapter 39A, Education Code, is
1211 amended by adding Section 39A.1011 to read as follows:
1312 Sec. 39A.1011. CAMPUS TURNAROUND PLAN TO OPERATE AS
1413 COMMUNITY SCHOOL. (a) A campus turnaround plan may permit a campus
1514 to operate as a community school. A plan to operate as a community
1615 school must include, in addition to the other requirements of this
1716 subchapter, strategies and programs to coordinate academic,
1817 social, and health services and reduce barriers to learning through
1918 partnerships and service coordination.
2019 (b) Programs and services offered by a campus operating as a
2120 community school under a campus turnaround plan may include:
2221 (1) early childhood education;
2322 (2) after-school and summer school academic and
2423 enrichment programs;
2524 (3) college and career preparation;
2625 (4) service learning opportunities, such as
2726 internships and community service programs;
2827 (5) leadership and mentoring programs;
2928 (6) activities to encourage community and parent
3029 engagement in students' education;
3130 (7) health and social services for students and their
3231 families; and
3332 (8) parenting classes.
3433 (c) A campus that elects to operate as a community school
3534 under a campus turnaround plan must:
3635 (1) establish a school community partnership team,
3736 composed of the members required for a campus-level planning and
3837 decision-making committee under Section 11.251 and additional
3938 community representatives, to coordinate with the campus
4039 intervention team for the campus;
4140 (2) establish a partnership with a lead organization
4241 that has experience in developing and implementing a community
4342 school plan;
4443 (3) designate a school district employee or an
4544 employee of an organization with experience in developing and
4645 implementing a community school plan as the community school
4746 coordinator for the campus, whose duties must include the
4847 recruitment and coordination of services from community partners;
4948 (4) develop a community school plan that satisfies the
5049 requirements for a campus improvement plan under Section 11.253;
5150 and
5251 (5) obtain approval for the community school plan
5352 from:
5453 (A) at least 75 percent of campus faculty and
5554 staff and 75 percent of parents of students enrolled at the campus;
5655 and
5756 (B) the board of trustees of the school district
5857 in which the campus is located.
5958 SECTION 2. Section 39A.107, Education Code, is amended by
6059 adding Subsection (d) to read as follows:
6160 (d) Notwithstanding Subsection (c), the commissioner may
6261 not order the closure of a campus under this section without giving
6362 the campus the opportunity to operate as a community school under a
6463 campus turnaround plan as provided by Section 39A.1011 and at least
6564 two years to implement the campus's community school plan.
6665 SECTION 3. Section 39A.111, Education Code, is amended to
6766 read as follows:
6867 Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING.
6968 (a) If a campus is considered to have an unacceptable performance
7069 rating for three consecutive school years after the campus is
7170 ordered to submit a campus turnaround plan under Section 39A.101,
7271 the commissioner, subject to Section 39A.112, shall order:
7372 (1) appointment of a board of managers to govern the
7473 school district as provided by Section 39A.202; or
7574 (2) closure of the campus.
7675 (b) Notwithstanding Subsection (a), the commissioner may
7776 not order the closure of a campus under this section without giving
7877 the campus the opportunity to operate as a community school under a
7978 campus turnaround plan as provided by Section 39A.1011 and at least
8079 two years to implement the campus's community school plan.
8180 SECTION 4. This Act takes effect immediately if it receives
8281 a vote of two-thirds of all the members elected to each house, as
8382 provided by Section 39, Article III, Texas Constitution. If this
8483 Act does not receive the vote necessary for immediate effect, this
8584 Act takes effect September 1, 2021.
