55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring disability studies as part of the enrichment
88 curriculum for public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002(a), Education Code, is amended to
1111 read as follows:
1212 (a) Each school district that offers kindergarten through
1313 grade 12 shall offer, as a required curriculum:
1414 (1) a foundation curriculum that includes:
1515 (A) English language arts;
1616 (B) mathematics;
1717 (C) science; and
1818 (D) social studies, consisting of Texas, United
1919 States, and world history, government, economics, with emphasis on
2020 the free enterprise system and its benefits, and geography; and
2121 (2) an enrichment curriculum that includes:
2222 (A) to the extent possible, languages other than
2323 English;
2424 (B) health, with emphasis on:
2525 (i) physical health, including the
2626 importance of proper nutrition and exercise;
2727 (ii) mental health, including instruction
2828 about mental health conditions, substance abuse, skills to manage
2929 emotions, establishing and maintaining positive relationships, and
3030 responsible decision-making; and
3131 (iii) suicide prevention, including
3232 recognizing suicide-related risk factors and warning signs;
3333 (C) physical education;
3434 (D) fine arts;
3535 (E) career and technology education;
3636 (F) technology applications;
3737 (G) religious literature, including the Hebrew
3838 Scriptures (Old Testament) and New Testament, and its impact on
3939 history and literature; [and]
4040 (H) personal financial literacy; and
4141 (I) disability studies.
4242 SECTION 2. Subchapter A, Chapter 28, Education Code, is
4343 amended by adding Section 28.0022 to read as follows:
4444 Sec. 28.0022. DISABILITY STUDIES. (a) In this section,
4545 "ableism" means discrimination in favor of able-bodied persons.
4646 (b) The Texas essential knowledge and skills and, as
4747 applicable, Section 28.025 shall include instruction in disability
4848 studies in:
4949 (1) social studies instruction in kindergarten
5050 through grade eight; and
5151 (2) one or more courses offered for high school
5252 graduation.
5353 (c) Each school district and each open-enrollment charter
5454 school that offers a high school program shall provide an elective
5555 course in disability studies that meets the requirements for a
5656 one-half elective credit under Section 28.025, using materials
5757 approved by the State Board of Education.
5858 (d) The instruction in disability studies must include
5959 information regarding:
6060 (1) disability identity;
6161 (2) disability culture;
6262 (3) the social model of disability;
6363 (4) the disability rights movement;
6464 (5) past and present leaders in the field of
6565 disability;
6666 (6) federal and state law affecting persons with
6767 disabilities;
6868 (7) exerting self-determination;
6969 (8) engaging in self-advocacy; and
7070 (9) concepts and theories to combat ableism.
7171 SECTION 3. This Act applies beginning with the 2021-2022
7272 school year.
7373 SECTION 4. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2021.
