86 AN ACT
9- relating to the basic peace officer training course, including
10- training for peace officers on the prohibition against the
11- intentional use of certain neck restraints.
7+ relating to prohibiting the use of certain techniques when using
8+ force to make an arrest or search.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Subchapter F, Chapter 1701, Occupations Code, is
14- amended by adding Section 1701.2551 to read as follows:
15- Sec. 1701.2551. BASIC PEACE OFFICER TRAINING COURSE;
16- PROHIBITED USE OF CERTAIN RESTRAINTS. (a) The basic peace officer
17- training course required as part of a peace officer training
18- program under Section 1701.251(a) may be no less than 720 hours.
19- (b) The basic peace officer training course must include
20- training on the prohibition against the intentional use of a choke
21- hold, carotid artery hold, or similar neck restraint by a peace
22- officer in searching or arresting a person, unless the officer
23- reasonably believes the restraint is necessary to prevent serious
24- bodily injury to or the death of the peace officer or another
25- person.
26- SECTION 2. (a) Not later than January 1, 2022, the Texas
27- Commission on Law Enforcement shall modify the curriculum of the
28- basic peace officer training course as necessary to comply with
29- Section 1701.2551, Occupations Code, as added by this Act.
30- (b) The minimum hour and content requirements for the basic
31- peace officer training course under Section 1701.2551, Occupations
32- Code, as added by this Act, apply only to a person who first begins
33- the course on or after July 1, 2022.
10+ SECTION 1. Subchapter E, Chapter 9, Penal Code, is amended
11+ by adding Section 9.515 to read as follows:
12+ Sec. 9.515. PROHIBITED TECHNIQUES. Notwithstanding any
13+ other law, the use of force or deadly force against a person is not
14+ justified under Section 9.51 if the force or deadly force is used in
15+ a manner that impedes the normal breathing or circulation of the
16+ blood of the person by applying pressure to the person's throat or
17+ neck or by blocking the person's nose or mouth.
18+ SECTION 2. The change in law made by this Act applies only
19+ to an offense committed on or after the effective date of this Act.
20+ An offense committed before the effective date of this Act is
21+ governed by the law in effect on the date the offense was committed,
22+ and the former law is continued in effect for that purpose. For
23+ purposes of this section, an offense was committed before the
24+ effective date of this Act if any element of the offense occurred
25+ before that date.
3426 SECTION 3. This Act takes effect September 1, 2021.
