66 AN ACT
77 relating to local government regulations based on utility service
88 type.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 250, Local Government Code, is amended
1111 by adding Section 250.011 to read as follows:
1212 Sec. 250.011. PROHIBITION ON REGULATIONS BASED ON TYPE OF
1313 UTILITY SERVICE. (a) A political subdivision requiring the
1414 issuance of a building permit may not deny a permit application
1515 based on the type of utility service provided to the project.
1616 (b) A political subdivision issuing a building permit shall
1717 ensure that all applicable permits and fees contain requirements
1818 and amounts that do not:
1919 (1) exceed the requirements and amounts for the use of
2020 other types of utility services; or
2121 (2) have the effect of restricting a permit
2222 applicant's ability to use a specific type of utility service from a
2323 provider that is authorized to provide service.
2424 (c) An ordinance, order, or other regulation adopted by a
2525 political subdivision may not restrict a person's ability to use a
2626 specific type of utility service from a provider that is authorized
2727 to provide service.
2828 (d) A political subdivision may not impose a fine, penalty,
2929 or other requirement based on type of utility service that has the
3030 effect of restricting a utility provider's authority to operate or
3131 serve customers.
3232 (e) This section does not affect the authority of a
3333 political subdivision to:
3434 (1) manage the public highways within the political
3535 subdivision's boundaries; or
3636 (2) exercise the political subdivision's police powers
3737 to review and approve an application before issuing a permit.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2021.
