| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 191.0049, Health and Safety Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 191.0049. BIRTH RECORD ISSUED TO FOSTER CHILD OR YOUTH |
|---|
| 11 | 11 | | OR HOMELESS [CHILD OR YOUTH] INDIVIDUAL. (a) On request of a child |
|---|
| 12 | 12 | | [or], youth, or homeless individual described by this section, the |
|---|
| 13 | 13 | | state registrar, a local registrar, or a county clerk shall issue, |
|---|
| 14 | 14 | | without fee or parental consent, a certified copy of the [child's or |
|---|
| 15 | 15 | | youth's] requestor's birth record to: |
|---|
| 16 | 16 | | (1) a homeless child or youth as defined by 42 U.S.C. |
|---|
| 17 | 17 | | Section 11434a; |
|---|
| 18 | 18 | | (2) a child in the managing conservatorship of the |
|---|
| 19 | 19 | | Department of Family and Protective Services; [and] |
|---|
| 20 | 20 | | (3) a young adult who: |
|---|
| 21 | 21 | | (A) is at least 18 years of age, but younger than |
|---|
| 22 | 22 | | 21 years of age; and |
|---|
| 23 | 23 | | (B) resides in a foster care placement, the cost |
|---|
| 24 | 24 | | of which is paid by the Department of Family and Protective |
|---|
| 25 | 25 | | Services[.]; and |
|---|
| 26 | 26 | | (4) a homeless individual as defined by 42 U.S.C. |
|---|
| 27 | 27 | | Section 11302. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2021. |
