66 AN ACT
77 relating to the right of certain facility residents to designate an
88 essential caregiver for in-person visitation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 4, Health and Safety Code, is
1111 amended by adding Chapter 260B to read as follows:
1212 CHAPTER 260B. RIGHT TO ESSENTIAL CAREGIVER VISITS FOR CERTAIN
1313 FACILITY RESIDENTS
1414 Sec. 260B.0001. DEFINITIONS. In this chapter:
1515 (1) "Essential caregiver" means a family member,
1616 friend, or other individual selected by a facility resident for
1717 in-person visits.
1818 (2) "Executive commissioner" means the executive
1919 commissioner of the Health and Human Services Commission.
2020 (3) "Facility" means:
2121 (A) a nursing facility licensed under Chapter
2222 242; or
2323 (B) an assisted living facility licensed under
2424 Chapter 247.
2525 (4) "Resident" means an individual, including a
2626 patient, who resides in a facility.
2727 Sec. 260B.0002. RESIDENT'S RIGHT TO ESSENTIAL CAREGIVER
2828 VISITS. (a) A facility resident has the right to designate at
2929 least one essential caregiver with whom the facility may not
3030 prohibit in-person visitation.
3131 (b) Notwithstanding Subsection (a), the executive
3232 commissioner by rule shall develop guidelines to assist facilities
3333 in establishing essential caregiver visitation policies and
3434 procedures. The guidelines must require the facilities to:
3535 (1) allow residents to designate for in-person
3636 visitation at least one essential caregiver, and more than one if
3737 needed;
3838 (2) establish a visitation schedule allowing the
3939 essential caregiver to visit the resident for the greater of two
4040 hours each day or the hours necessary for the caregiver to complete
4141 all caregiving tasks;
4242 (3) establish procedures to enable personal contact
4343 between the resident and essential caregiver while requiring social
4444 distancing between the caregiver and facility staff;
4545 (4) obtain a signed acknowledgment from the essential
4646 caregiver in which the caregiver agrees to follow the facility's
4747 safety protocols, including:
4848 (A) wearing personal protective equipment while
4949 visiting the resident;
5050 (B) completing a health screening before
5151 entering the facility;
5252 (C) submitting to regular viral testing; and
5353 (D) monitoring symptoms, practicing social
5454 distancing, and limiting contact with individuals outside of the
5555 facility; and
5656 (5) establish a visitor's log for contact tracing.
5757 (c) In the event of a conflict between this section and any
5858 other law, this section prevails.
5959 SECTION 2. Chapter 555, Health and Safety Code, is amended
6060 by adding Subchapter F to read as follows:
6161 SUBCHAPTER F. RIGHT TO ESSENTIAL CAREGIVER VISITS
6262 Sec. 555.201. DEFINITION. In this chapter, "essential
6363 caregiver" means a family member, friend, or other individual
6464 selected by a resident for in-person visits.
6565 Sec. 555.202. RESIDENT'S RIGHT TO ESSENTIAL CAREGIVER
6666 VISITS. (a) A resident of a state supported living center has the
6767 right to designate at least one essential caregiver with whom the
6868 center may not prohibit in-person visitation.
6969 (b) Notwithstanding Subsection (a), the executive
7070 commissioner by rule shall develop guidelines to assist state
7171 supported living centers in establishing essential caregiver
7272 visitation policies and procedures. The guidelines must require the
7373 centers to:
7474 (1) allow residents to designate for in-person
7575 visitation at least one essential caregiver, and more than one if
7676 needed;
7777 (2) establish a visitation schedule allowing the
7878 essential caregiver to visit the resident for the greater of two
7979 hours each day or the hours necessary for the caregiver to complete
8080 all caregiving tasks;
8181 (3) establish procedures to enable personal contact
8282 between the resident and essential caregiver while requiring social
8383 distancing between the caregiver and center staff;
8484 (4) obtain a signed acknowledgement from the essential
8585 caregiver in which the caregiver agrees to follow the center's
8686 safety protocols, including:
8787 (A) wearing personal protective equipment while
8888 visiting the resident;
8989 (B) completing a health screening before
9090 entering the center;
9191 (C) submitting to regular viral testing; and
9292 (D) monitoring symptoms, practicing social
9393 distancing, and limiting contact with individuals outside of the
9494 center; and
9595 (5) establish a visitor's log for contact tracing.
9696 (c) In the event of a conflict between this section and any
9797 other law, this section prevails.
9898 SECTION 3. As soon as practicable after the effective date
9999 of this Act, the executive commissioner of the Health and Human
100100 Services Commission shall establish the guidelines required by
101101 Sections 260B.0002 and 555.202, Health and Safety Code, as added by
102102 this Act.
103103 SECTION 4. This Act takes effect September 1, 2021.
