8 | 8 | | Environmental Quality for certain oil and gas facilities. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
---|
11 | 11 | | Code, is amended by adding Section 382.051965 to read as follows: |
---|
12 | 12 | | Sec. 382.051965. INSPECTION AND MAINTENANCE REQUIREMENTS |
---|
13 | 13 | | FOR OIL AND GAS FACILITIES. (a) A permit by rule or a standard |
---|
14 | 14 | | permit relating to a facility described by Section 382.051961(a) |
---|
15 | 15 | | must require: |
---|
16 | 16 | | (1) the permit holder of a new facility or an existing |
---|
17 | 17 | | facility that has been modified to establish a quarterly inspection |
---|
18 | 18 | | and maintenance program for the detection and repair of leaks from |
---|
19 | 19 | | all valves, pump seals, flanges, compressor seals, pressure relief |
---|
20 | 20 | | valves, open-ended lines, tanks, and other process and operation |
---|
21 | 21 | | components of the facility that could result in fugitive emissions; |
---|
22 | 22 | | (2) for a new facility, a prohibition on the use of |
---|
23 | 23 | | venting and limitations on the use of flaring; |
---|
24 | 24 | | (3) for an existing facility that has been modified, |
---|
25 | 25 | | the elimination of the use of venting and a reduction in the use of |
---|
26 | 26 | | flaring; |
---|
27 | 27 | | (4) limitations on emissions of volatile organic |
---|
28 | 28 | | compounds from storage tanks that have the potential to emit more |
---|
29 | 29 | | than one ton of volatile organic compounds per year; |
---|
30 | 30 | | (5) limitations on emissions of nitrogen oxides from |
---|
31 | 31 | | compressor engines with more than 100 horsepower; |
---|
32 | 32 | | (6) maintenance protocols and best practices for |
---|
33 | 33 | | compressor stations; and |
---|
34 | 34 | | (7) the use and maintenance of no-bleed and low-bleed |
---|
35 | 35 | | pneumatic devices and controllers between a wellhead and a natural |
---|
36 | 36 | | gas processing plant and the monitoring of emissions from those |
---|
37 | 37 | | devices. |
---|
38 | 38 | | (b) A program described by Subsection (a)(1) must require |
---|
39 | 39 | | the use of leak detection equipment such as optical gas imaging |
---|
40 | 40 | | cameras. |
---|
41 | 41 | | (c) In adopting rules to implement this section, the |
---|
42 | 42 | | commission may consider: |
---|
43 | 43 | | (1) applying different standards to new facilities and |
---|
44 | 44 | | facilities that have been modified; and |
---|
45 | 45 | | (2) using incentives to encourage the use of best |
---|
46 | 46 | | practices at facilities subject to this section. |
---|
47 | 47 | | SECTION 2. Not later than June 1, 2022, the Texas Commission |
---|
48 | 48 | | on Environmental Quality shall adopt rules as necessary to |
---|
49 | 49 | | implement Section 382.051965, Health and Safety Code, as added by |
---|
50 | 50 | | this Act. |
---|
51 | 51 | | SECTION 3. This Act takes effect September 1, 2021. |
