66 AN ACT
77 relating to air quality permits issued by the Texas Commission on
88 Environmental Quality for certain oil and gas facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1111 Code, is amended by adding Section 382.051965 to read as follows:
1212 Sec. 382.051965. INSPECTION AND MAINTENANCE REQUIREMENTS
1313 FOR OIL AND GAS FACILITIES. (a) A permit by rule or a standard
1414 permit relating to a facility described by Section 382.051961(a)
1515 must require:
1616 (1) the permit holder of a new facility or an existing
1717 facility that has been modified to establish a quarterly inspection
1818 and maintenance program for the detection and repair of leaks from
1919 all valves, pump seals, flanges, compressor seals, pressure relief
2020 valves, open-ended lines, tanks, and other process and operation
2121 components of the facility that could result in fugitive emissions;
2222 (2) for a new facility, a prohibition on the use of
2323 venting and limitations on the use of flaring;
2424 (3) for an existing facility that has been modified,
2525 the elimination of the use of venting and a reduction in the use of
2626 flaring;
2727 (4) limitations on emissions of volatile organic
2828 compounds from storage tanks that have the potential to emit more
2929 than one ton of volatile organic compounds per year;
3030 (5) limitations on emissions of nitrogen oxides from
3131 compressor engines with more than 100 horsepower;
3232 (6) maintenance protocols and best practices for
3333 compressor stations; and
3434 (7) the use and maintenance of no-bleed and low-bleed
3535 pneumatic devices and controllers between a wellhead and a natural
3636 gas processing plant and the monitoring of emissions from those
3737 devices.
3838 (b) A program described by Subsection (a)(1) must require
3939 the use of leak detection equipment such as optical gas imaging
4040 cameras.
4141 (c) In adopting rules to implement this section, the
4242 commission may consider:
4343 (1) applying different standards to new facilities and
4444 facilities that have been modified; and
4545 (2) using incentives to encourage the use of best
4646 practices at facilities subject to this section.
4747 SECTION 2. Not later than June 1, 2022, the Texas Commission
4848 on Environmental Quality shall adopt rules as necessary to
4949 implement Section 382.051965, Health and Safety Code, as added by
5050 this Act.
5151 SECTION 3. This Act takes effect September 1, 2021.
