66 AN ACT
77 relating to an interagency grant program to support and sustain the
88 operations of community recovery organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 53 to read as follows:
1212 CHAPTER 53. COMMUNITY RECOVERY ORGANIZATION GRANT PROGRAM
1313 Sec. 53.001. DEFINITIONS. In this chapter:
1414 (1) "Community recovery organization" means a
1515 nonprofit organization that:
1616 (A) mobilizes resources inside and outside of a
1717 local community to increase the prevalence and quality of long-term
1818 recovery for individuals with a substance use or mental health
1919 condition and their affected family members;
2020 (B) is governed by members of the local
2121 community:
2222 (i) at least 51 percent of whom identify as
2323 an individual recovering from a substance use or mental health
2424 condition; and
2525 (ii) the remainder of whom identify as an
2626 affected family member of an individual recovering from a substance
2727 use or mental health condition; and
2828 (C) aligns with applicable national best
2929 practices recognized by the commission.
3030 (2) "Grant program" means the community recovery
3131 organization grant program established under this chapter.
3232 Sec. 53.002. ESTABLISHMENT AND ADMINISTRATION OF GRANT
3333 PROGRAM. (a) The community recovery organization grant program is
3434 established as an interagency grant program to provide grants to
3535 community recovery organizations to support and sustain the
3636 operations of the organizations.
3737 (b) The commission shall serve as the administrator of the
3838 grant program. The grant program consists of the following
3939 additional state agencies:
4040 (1) the department;
4141 (2) the Department of Family and Protective Services;
4242 (3) the Texas Education Agency;
4343 (4) the Department of Agriculture;
4444 (5) the Texas Department of Housing and Community
4545 Affairs;
4646 (6) the Texas Department of Criminal Justice;
4747 (7) the Texas Juvenile Justice Department;
4848 (8) the Texas Veterans Commission; and
4949 (9) the Texas A&M AgriLife Extension Service.
5050 (c) The commission may provide a grant to a community
5151 recovery organization only in accordance with a contract between
5252 the commission and the community recovery organization. The
5353 contract must include provisions under which the commission is
5454 granted sufficient control to ensure the public purpose of
5555 substance use or mental health recovery is accomplished and the
5656 state receives the return benefit.
5757 Sec. 53.003. FUNDING. (a) Not later than September 1 of
5858 each even-numbered year, the commission and each state agency
5959 listed under Section 53.002(b) shall identify available resources
6060 under the agency's control that may be used to fund and provide
6161 grants to community recovery organizations under the grant program.
6262 (b) In addition to the resources identified under
6363 Subsection (a) and any money appropriated by the legislature for
6464 the grant program, the commission may solicit and accept gifts,
6565 grants, or donations from any source to administer and provide
6666 grants to community recovery organizations under the grant program.
6767 Sec. 53.004. MEMORANDUM OF UNDERSTANDING. The executive
6868 commissioner of the commission and the executive head of each state
6969 agency listed under Section 53.002(b) with rulemaking authority
7070 each by rule shall adopt a memorandum of understanding that defines
7171 the commission's and each other agency's responsibilities with
7272 respect to administering and operating the grant program.
7373 SECTION 2. As soon as practicable after the effective date
7474 of this Act, the executive commissioner of the Health and Human
7575 Services Commission and the executive head of each state agency
7676 listed under Section 53.002(b), Health and Safety Code, as added by
7777 this Act, with rulemaking authority by rule shall adopt the
7878 memorandum of understanding required by Section 53.004, Health and
7979 Safety Code, as added by this Act.
8080 SECTION 3. This Act takes effect September 1, 2021.
