| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter A, Chapter 418, Government Code, is | |
| 12 | 12 | amended by adding Section 418.0035 to read as follows: | |
| 13 | 13 | Sec. 418.0035. PROHIBITION. The governor or the presiding | |
| 14 | 14 | officer of the governing body of a political subdivision may not | |
| 15 | 15 | issue an order during a declared state of disaster or local state of | |
| 16 | 16 | disaster that restricts the operation of a business or industry or | |
| 17 | 17 | the activities of an individual by distinguishing between essential | |
| 18 | 18 | and nonessential services provided or obtained by the business, | |
| 19 | 19 | industry, or individual. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2021. |
