| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 2155, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2155.454 to read as follows: |
|---|
| 12 | 12 | | Sec. 2155.454. PREFERENCE FOR SMALL BUSINESS. (a) In this |
|---|
| 13 | 13 | | section, "small business" has the meaning assigned by Section |
|---|
| 14 | 14 | | 2155.505. |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (c), the comptroller |
|---|
| 16 | 16 | | and each state agency that enters into a contract for the purchase |
|---|
| 17 | 17 | | of goods or services with a value of less than $500,000 shall give |
|---|
| 18 | 18 | | preference to goods or services produced or offered by a small |
|---|
| 19 | 19 | | business. |
|---|
| 20 | 20 | | (c) This section does not apply to the purchase of |
|---|
| 21 | 21 | | telecommunications equipment, telecommunications service, |
|---|
| 22 | 22 | | advanced communications services, or information service, as those |
|---|
| 23 | 23 | | terms are defined by 47 U.S.C. Section 153. |
|---|
| 24 | 24 | | (d) The comptroller may adopt rules to implement this |
|---|
| 25 | 25 | | section. |
|---|
| 26 | 26 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 27 | | to a contract for the purchase of goods or services that is entered |
|---|
| 28 | 28 | | into on or after the effective date of this Act. A contract entered |
|---|
| 29 | 29 | | into before the effective date of this Act is governed by the law in |
|---|
| 30 | 30 | | effect on the date the contract was entered into, and the former law |
|---|
| 31 | 31 | | is continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2021. |
