104 A BILL TO BE ENTITLED
115 AN ACT
126 relating to the marketing and sale of catfish and similar fish by
137 food service establishments; providing administrative and civil
148 penalties.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Chapter 436, Health and Safety Code, is amended
1711 by adding Subchapter J to read as follows:
1812 SUBCHAPTER J. MARKETING AND SALE OF CATFISH AND
1913 FISH SIMILAR TO CATFISH
2014 Sec. 436.121. DEFINITIONS. In this subchapter:
2115 (1) "Catfish" means any species of the scientific
2216 family Ictaluridae. The term does not include any species of the
2317 scientific genus Pangasius, family Clariidae or family Siluridae,
2418 including Swai fish.
2519 (2) "Food service establishment" has the meaning
2620 assigned by Section 437.001.
2721 (3) "Menu board" means a posted list or pictorial
2822 display of food items offered for sale by a food service
2923 establishment.
3024 Sec. 436.122. REQUIREMENTS FOR FOOD SERVICE
3125 ESTABLISHMENTS. (a) A food service establishment that offers a
3226 food product for sale may represent and identify the product as
3327 catfish only if the product contains catfish and does not contain
3428 another fish similar to catfish.
3529 (b) A food service establishment that offers for sale a food
3630 product containing a fish similar to catfish that is not catfish:
3731 (1) may not represent the product as catfish; and
3832 (2) shall conspicuously identify the type of fish
3933 contained in the product in the description of the product on the
4034 establishment's menu or menu board.
4135 Sec. 436.123. ADMINISTRATIVE PENALTY. (a) The department,
4236 or a public health district or county that requires a food service
4337 establishment to hold a permit under Chapter 437, may impose an
4438 administrative penalty against a food service establishment that
4539 violates this subchapter or a rule adopted under this subchapter.
4640 (b) The penalty for a violation may be in an amount not to
4741 exceed:
4842 (1) $250 for a food service establishment with gross
4943 annual food sales of less than $50,000;
5044 (2) $500 for a food service establishment with gross
5145 annual food sales of at least $50,000 but less than $145,000; and
5246 (3) $750 for a food service establishment with gross
5347 annual food sales of at least $145,000.
5448 (c) Each day a violation continues or occurs is a separate
5549 violation for purposes of imposing a penalty.
5650 Sec. 436.124. CIVIL PENALTY. (a) A food service
5751 establishment that violates this subchapter or a rule adopted under
5852 this subchapter is liable to this state, or a public health district
5953 or county that requires the food service establishment to hold a
6054 permit under Chapter 437, for a civil penalty in an amount not to
6155 exceed:
6256 (1) $250 for a food service establishment with gross
6357 annual food sales of less than $50,000;
6458 (2) $500 for a food service establishment with gross
6559 annual food sales of at least $50,000 but less than $145,000; and
6660 (3) $750 for a food service establishment with gross
6761 annual food sales of at least $145,000.
6862 (b) Each day a violation continues or occurs is a separate
6963 violation for purposes of imposing a penalty.
7064 (c) The attorney general, the district or county attorney
7165 for the county, or the municipal attorney of the municipality in
7266 which the violation is alleged to have occurred may bring an action
7367 to recover a civil penalty under this section.
7468 SECTION 2. This Act takes effect September 1, 2021.
