| 9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 9 | | SECTION 1. Chapter 322, Government Code, is amended by |
|---|
| 11 | 10 | | adding Section 322.0195 to read as follows: |
|---|
| 12 | 11 | | Sec. 322.0195. RECIDIVISM REPORT. (a) The board shall |
|---|
| 13 | 12 | | prepare a biennial report on recidivism that includes rearrest, |
|---|
| 14 | 13 | | reconviction, and reincarceration rates. The report must include: |
|---|
| 15 | 14 | | (1) statewide rates and rates for each county in this |
|---|
| 16 | 15 | | state; and |
|---|
| 17 | 16 | | (2) information regarding: |
|---|
| 18 | 17 | | (A) individuals who have served any part of a |
|---|
| 19 | 18 | | sentence in a county jail; and |
|---|
| 20 | 19 | | (B) individuals who are rearrested, reconvicted, |
|---|
| 21 | 20 | | or reincarcerated in other states. |
|---|
| 22 | 21 | | (b) In preparing the report, the board shall collaborate |
|---|
| 23 | 22 | | with the Department of Public Safety. The Department of Public |
|---|
| 24 | 23 | | Safety shall provide any information requested by the board for the |
|---|
| 25 | 24 | | purpose of preparing the report. |
|---|
| 26 | 25 | | (c) The report may be included in any other report made by |
|---|
| 27 | 26 | | the board. |
|---|
| 28 | 27 | | (d) Not later than December 1 of each even-numbered year, |
|---|
| 29 | 28 | | the board shall submit the report to the governor, lieutenant |
|---|
| 30 | 29 | | governor, and each member of the legislature. |
|---|
| 31 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 34 | | Act takes effect September 1, 2021. |
