| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 24.07, Alcoholic Beverage Code, as |
|---|
| 11 | 11 | | effective September 1, 2021, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 24.07. HOURS OF SALE. A holder of a wine only package |
|---|
| 13 | 13 | | store permit may remain open and sell malt beverages, wine, and |
|---|
| 14 | 14 | | vinous liquors, for off-premises consumption only, on any day and |
|---|
| 15 | 15 | | during the same hours that the holder of a wine and malt beverage |
|---|
| 16 | 16 | | retailer's permit may sell malt beverages and wine, except that the |
|---|
| 17 | 17 | | permittee may not sell wine or vinous liquor containing more than 17 |
|---|
| 18 | 18 | | percent alcohol by volume [on a Sunday or] after 10 p.m. on any day. |

| 19 | 19 | | SECTION 2. Section 105.01, Alcoholic Beverage Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | Sec. 105.01. HOURS OF SALE: LIQUOR. [(a)] Except as |
|---|
| 22 | 22 | | provided in Sections 105.02, 105.03, 105.04, and 105.08, no person |
|---|
| 23 | 23 | | may sell, offer for sale, or deliver any liquor: |
|---|
| 24 | 24 | | (1) on New Year's Day, Thanksgiving Day, or Christmas |
|---|
| 25 | 25 | | Day; |
|---|
| 26 | 26 | | (2) before noon or after 10 p.m. on Sunday; or |
|---|
| 27 | 27 | | (3) before 9 [10] a.m. or after 10 [9] p.m. on any |
|---|
| 28 | 28 | | other day. |
|---|
| 29 | 29 | | [(b) When Christmas Day or New Year's Day falls on a Sunday, |
|---|
| 30 | 30 | | Subsection (a) of this section applies to the following Monday.] |

| 31 | 31 | | SECTION 3. Section 105.02, Alcoholic Beverage Code, is |

| 34 | 34 | | DISTRIBUTORS TO RETAILERS. (a) A holder of a wholesaler's permit |

| 35 | 35 | | may sell, offer for sale, or deliver liquor to a retailer anytime |
|---|
| 36 | 36 | | except [Sunday and] Christmas Day. |

| 37 | 37 | | (b) A local distributor's permittee may sell, offer for |

| 38 | 38 | | sale, or deliver liquor to a retailer between 5 a.m. and 9 p.m. on |

| 39 | 39 | | any day except: |
|---|
| 40 | 40 | | (1) [Sunday; |
|---|
| 41 | 41 | | [(2)] Christmas Day; or |
|---|
| 42 | 42 | | (2) [(3)] a day on which a package store permittee is |

| 43 | 43 | | prohibited from selling liquor. |

| 44 | 44 | | SECTION 4. This Act takes effect September 1, 2021. |
