97 relating to the creation of a work group to study uniform quality
108 measures under a value-based program for long-term services and
119 supports.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter A, Chapter 531, Government Code, is
1412 amended by adding Section 531.01211 to read as follows:
1513 Sec. 531.01211. WORK GROUP ON UNIFORM QUALITY MEASURES
1614 UNDER VALUE-BASED PROGRAM FOR LONG-TERM SERVICES AND SUPPORTS. (a)
1715 The commission shall establish within the advisory committee
1816 established under Section 531.012 that studies value-based payment
1917 and quality improvement initiatives a work group to study, develop,
2018 and recommend uniform quality measures to be implemented under a
2119 value-based program for long-term services and supports. The work
2220 group shall:
2321 (1) develop an underlying methodology for measuring
2422 quality under the value-based program;
2523 (2) identify the data sources that should be used in
2624 the methodology; and
2725 (3) develop a process for reporting, collecting, and
2826 validating the data used in the methodology.
2927 (b) The work group shall engage stakeholders representing
30- clients who receive long-term services and supports and providers
31- and relevant industries that provide community-based long-term
32- services and supports to assist in developing uniform quality
33- measures under Subsection (a).

3431 (c) To the extent permitted by federal law, data collected
3532 and the uniform quality measures developed by the work group under

37- (d) Not later than January 10, 2023, the commission, in

4037 is established, shall submit a report on the findings and
4138 recommendations of the work group to the governor, the lieutenant
4239 governor, and the standing committees of the senate and house of
4340 representatives having primary jurisdiction over Medicaid. The
4441 report must include:
4542 (1) the uniform quality measures developed and
4643 recommended by the work group under Subsection (a), including any
4744 methodology recommended by the work group for measuring quality;
4845 and
4946 (2) the commission's recommendations for implementing
5047 those quality measures, including a proposed timeline for
5148 implementation of the measures and a description of any potential
5249 legislation that would be required for implementation of the
5350 measures.
5451 (e) This section expires September 1, 2023.
5552 SECTION 2. This Act takes effect September 1, 2021.
