8	6		AN ACT
9	7		relating to the creation of a work group to study uniform quality
10	8		measures under a value-based program for long-term services and
11	9		supports.
12	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	11		SECTION 1. Subchapter A, Chapter 531, Government Code, is
14	12		amended by adding Section 531.01211 to read as follows:
15	13		Sec. 531.01211. WORK GROUP ON UNIFORM QUALITY MEASURES
16	14		UNDER VALUE-BASED PROGRAM FOR LONG-TERM SERVICES AND SUPPORTS. (a)
17	15		The commission shall establish within the advisory committee
18	16		established under Section 531.012 that studies value-based payment
19	17		and quality improvement initiatives a work group to study, develop,
20	18		and recommend uniform quality measures to be implemented under a
21	19		value-based program for long-term services and supports. The work
22	20		group shall:
23	21		(1) develop an underlying methodology for measuring
24	22		quality under the value-based program;
25	23		(2) identify the data sources that should be used in
26	24		the methodology; and
27	25		(3) develop a process for reporting, collecting, and
28	26		validating the data used in the methodology.
29	27		(b) The work group shall engage stakeholders representing
30		-	clients who receive long-term services and supports and providers
31		-	and relevant industries that provide community-based long-term
32		-	services and supports to assist in developing uniform quality
33		-	measures under Subsection (a).

34	31		(c) To the extent permitted by federal law, data collected
35	32		and the uniform quality measures developed by the work group under
36	33		this section must be accessible to the public.
37		-	(d) Not later than ~~January 10~~, ~~2023~~, the commission, in

40	37		is established, shall submit a report on the findings and
41	38		recommendations of the work group to the governor, the lieutenant

43	40		representatives having primary jurisdiction over Medicaid. The
44	41		report must include:
45	42		(1) the uniform quality measures developed and
46	43		recommended by the work group under Subsection (a), including any
47	44		methodology recommended by the work group for measuring quality;
48	45		and
49	46		(2) the commission's recommendations for implementing
50	47		those quality measures, including a proposed timeline for
51	48		implementation of the measures and a description of any potential
52	49		legislation that would be required for implementation of the
53	50		measures.
54	51		(e) This section expires September 1, 2023.
55	52		SECTION 2. This Act takes effect September 1, 2021.
