| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 1001.101(b), Education Code, is amended | |
| 10 | 10 | to read as follows: | |
| 11 | 11 | (b) A driver education course must require the student to | |
| 12 | 12 | complete: | |
| 13 | 13 | (1) 7 hours of behind-the-wheel instruction in the | |
| 14 | 14 | presence of a person who holds a driver education instructor | |
| 15 | 15 | license or who meets the requirements for a driver education course | |
| 16 | 16 | conducted by a parent or other individual under Section 1001.112; | |
| 17 | 17 | (2) 7 hours of observation instruction in the presence | |
| 18 | 18 | of a person who holds a driver education instructor license or who | |
| 19 | 19 | meets the requirements for a driver education course conducted by a | |
| 20 | 20 | parent or other individual under Section 1001.112; and | |
| 21 | 21 | (3) 50 [30] hours of behind-the-wheel instruction, | |
| 22 | 22 | including at least 10 hours of instruction that takes place at | |
| 23 | 23 | night, in the presence of an adult who meets the requirements of | |
| 24 | 24 | Section 521.222(d)(2), Transportation Code. | |
| 25 | 25 | SECTION 2. The change in law made by this Act applies to a | |
| 26 | 26 | driver education course that begins on or after the effective date | |
| 27 | 27 | of this Act. A driver education course that begins before the | |
| 28 | 28 | effective date of this Act is governed by the law in effect on the | |
| 29 | 29 | date the course began, and the former law is continued in effect for | |
| 30 | 30 | that purpose. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2021. |
