55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the adoption of uniform general conditions for building
88 construction contracts entered into by school districts and the
99 composition of the committee that reviews uniform general
1010 conditions.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 44, Education Code, is
1313 amended by adding Section 44.035 to read as follows:
1414 Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR
1515 SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. After reviewing
1616 the uniform general conditions adopted by the Texas Facilities
1717 Commission under Section 2166.302, Government Code, a school
1818 district may adopt uniform general conditions to be incorporated in
1919 all district building construction contracts.
2020 SECTION 2. Section 2166.305(b), Government Code, is amended
2121 to read as follows:
2222 (b) A committee appointed by the commission shall perform
2323 the review. The committee consists of:
2424 (1) the director of facilities construction and space
2525 management appointed under Section 2152.104, who serves as the
2626 presiding officer of the committee;
2727 (2) six individuals appointed by the commission, one
2828 each from the lists of nominees submitted respectively by the:
2929 (A) president of the Texas Society of Architects;
3030 (B) president of the Texas Society of
3131 Professional Engineers;
3232 (C) presiding officer of the Executive Council of
3333 the Texas Associated General Contractors Chapters;
3434 (D) executive secretary of the Mechanical
3535 Contractors Associations of Texas, Incorporated;
3636 (E) executive secretary of the Texas Building and
3737 Construction Trades Council; and
3838 (F) president of the Associated Builders and
3939 Contractors of Texas;
4040 (3) one individual appointed by the commission
4141 representing an institution of higher education, as defined by
4242 Section 61.003, Education Code;
4343 (4) one individual appointed by the commission
4444 representing a state agency that has a substantial ongoing
4545 construction program;
4646 (5) one individual appointed by the commission
4747 representing the attorney general's office;
4848 (6) one individual appointed by the commission
4949 representing the interests of historically underutilized
5050 businesses; [and]
5151 (7) two individuals appointed by the commission, each
5252 representing a different minority contractors association;
5353 (8) one individual appointed by the commission
5454 representing the Texas Association of School Boards; and
5555 (9) one individual appointed by the commission
5656 representing the Texas Association of School Administrators.
5757 SECTION 3. Not later than December 1, 2021, the Texas
5858 Facilities Commission shall appoint two additional members to the
5959 committee in accordance with Section 2166.305(b), Government Code,
6060 as amended by this Act.
6161 SECTION 4. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2021.
