66 AN ACT
77 relating to the sealing of and discovery procedures relating to
88 certain recordings of children constituting evidence in a criminal
99 case in a criminal hearing or proceeding; creating a criminal
1010 offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Article 38.45, Code of Criminal
1313 Procedure, is amended to read as follows:
1414 Art. 38.45. EVIDENCE DEPICTING [OR DESCRIBING ABUSE OF OR]
1515 SEXUAL CONDUCT BY CHILD OR MINOR.
1616 SECTION 2. Article 38.45(a), Code of Criminal Procedure, is
1717 amended to read as follows:
1818 (a) During the course of a criminal hearing or proceeding,
1919 the court may not make available or allow to be made available for
2020 copying or dissemination to the public property or material:
2121 (1) that constitutes child pornography, as described
2222 by Section 43.26(a)(1), Penal Code; or
2323 (2) the promotion or possession of which is prohibited
2424 under Section 43.261, Penal Code[; or
2525 [(3) that is described by Section 2 or 5, Article
2626 38.071, of this code].
2727 SECTION 3. The heading to Article 39.14, Code of Criminal
2828 Procedure, is amended to read as follows:
2929 Art. 39.14. DISCOVERY; OFFENSE.
3030 SECTION 4. Article 39.14, Code of Criminal Procedure, is
3131 amended by amending Subsection (f) and adding Subsections (f-1),
3232 (f-2), and (f-3) to read as follows:
3333 (f) Except as provided by Subsection (f-1), the [The]
3434 attorney representing the defendant, or an investigator, expert,
3535 consulting legal counsel, or agent for the attorney representing
3636 the defendant, may allow a defendant, witness, or prospective
3737 witness to view the information provided under this article, but
3838 may not allow that person to have copies of the information
3939 provided, other than a copy of the witness's own statement. Before
4040 allowing that person to view a document or the witness statement of
4141 another under this subsection, the person possessing the
4242 information shall redact the address, telephone number, driver's
4343 license number, social security number, date of birth, and any bank
4444 account or other identifying numbers contained in the document or
4545 witness statement.
4646 (f-1) The attorney representing the defendant may allow the
4747 defendant or an investigator, expert, consulting legal counsel, or
4848 agent for the attorney representing the defendant to view a
4949 recording described by Section 2 or 5, Article 38.071, in the
5050 presence of the attorney representing the defendant but may not
5151 allow any of those persons to have a copy of the recording.
5252 (f-2) A person commits an offense if the person recklessly
5353 violates Subsection (f-1). An offense under this subsection is a
5454 state jail felony.
5555 (f-3) For purposes of Subsection (f) or (f-1) [this
5656 article], the defendant may not be the agent for the attorney
5757 representing the defendant.
5858 SECTION 5. The heading to Article 39.15, Code of Criminal
5959 Procedure, is amended to read as follows:
6060 Art. 39.15. DISCOVERY OF EVIDENCE DEPICTING [OR DESCRIBING
6161 ABUSE OF OR] SEXUAL CONDUCT BY CHILD OR MINOR.
6262 SECTION 6. Article 39.15(a), Code of Criminal Procedure, is
6363 amended to read as follows:
6464 (a) In the manner provided by this article, a court shall
6565 allow discovery under Article 39.14 of property or material:
6666 (1) that constitutes child pornography, as described
6767 by Section 43.26(a)(1), Penal Code; or
6868 (2) the promotion or possession of which is prohibited
6969 under Section 43.261, Penal Code[; or
7070 [(3) that is described by Section 2 or 5, Article
7171 38.071, of this code].
7272 SECTION 7. The change in law made by this Act applies to the
7373 prosecution of an offense committed on or after the effective date
7474 of this Act. The prosecution of an offense committed before the
7575 effective date of this Act is governed by the law in effect on the
7676 date the offense was committed, and the former law is continued in
7777 effect for that purpose. For purposes of this section, an offense
7878 is committed before the effective date of this Act if any element of
7979 the offense occurs before the effective date.
8080 SECTION 8. This Act takes effect September 1, 2021.
