| 8 | 8 | | certificate of title fees; increasing a fee. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 501.138(a) and (b), Transportation |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) An applicant for a title, other than the state or a |
|---|
| 13 | 13 | | political subdivision of the state, must pay a fee of: |
|---|
| 14 | 14 | | (1) $38 [$33] if the applicant's residence is a county |
|---|
| 15 | 15 | | located within a nonattainment area as defined under Section 107(d) |
|---|
| 16 | 16 | | of the federal Clean Air Act (42 U.S.C. Section 7407), as amended, |
|---|
| 17 | 17 | | or is an affected county, as defined by Section 386.001, Health and |
|---|
| 18 | 18 | | Safety Code; or |
|---|
| 19 | 19 | | (2) $33 [$28] if the applicant's residence is any other |
|---|
| 20 | 20 | | county. |
|---|
| 21 | 21 | | (b) The fees shall be distributed as follows: |
|---|
| 22 | 22 | | (1) $10 [$5] of the fee to the county treasurer for |
|---|
| 23 | 23 | | deposit in the officers' salary fund; |
|---|
| 24 | 24 | | (2) $8 of the fee to the department: |
|---|
| 25 | 25 | | (A) together with the application within the time |
|---|
| 26 | 26 | | prescribed by Section 501.023; or |
|---|
| 27 | 27 | | (B) if the fee is deposited in an |
|---|
| 28 | 28 | | interest-bearing account or certificate in the county depository or |
|---|
| 29 | 29 | | invested in an investment authorized by Subchapter A, Chapter 2256, |
|---|
| 30 | 30 | | Government Code, not later than the 35th day after the date on which |
|---|
| 31 | 31 | | the fee is received; and |
|---|
| 32 | 32 | | (3) the following amount to the comptroller at the |
|---|
| 33 | 33 | | time and in the manner prescribed by the comptroller: |
|---|
| 34 | 34 | | (A) $20 of the fee if the applicant's residence |
|---|
| 35 | 35 | | is a county located within a nonattainment area as defined under |
|---|
| 36 | 36 | | Section 107(d) of the federal Clean Air Act (42 U.S.C. Section |
|---|
| 37 | 37 | | 7407), as amended, or is an affected county, as defined by Section |
|---|
| 38 | 38 | | 386.001, Health and Safety Code; or |
|---|
| 39 | 39 | | (B) $15 of the fee if the applicant's residence |
|---|
| 40 | 40 | | is any other county. |
|---|
| 41 | 41 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 42 | 42 | | to the fee for an application for title that is filed on or after the |
|---|
| 43 | 43 | | effective date of this Act. The fee for an application for title |
|---|
| 44 | 44 | | that is filed before the effective date of this Act is governed by |
|---|
| 45 | 45 | | the law in effect on the date the application was filed, and the |
|---|
| 46 | 46 | | former law is continued in effect for that purpose. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2021. |
