66 AN ACT
77 relating to the collection and disposition of motor vehicle
88 certificate of title fees; increasing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 501.138(a) and (b), Transportation
1111 Code, are amended to read as follows:
1212 (a) An applicant for a title, other than the state or a
1313 political subdivision of the state, must pay a fee of:
1414 (1) $38 [$33] if the applicant's residence is a county
1515 located within a nonattainment area as defined under Section 107(d)
1616 of the federal Clean Air Act (42 U.S.C. Section 7407), as amended,
1717 or is an affected county, as defined by Section 386.001, Health and
1818 Safety Code; or
1919 (2) $33 [$28] if the applicant's residence is any other
2020 county.
2121 (b) The fees shall be distributed as follows:
2222 (1) $10 [$5] of the fee to the county treasurer for
2323 deposit in the officers' salary fund;
2424 (2) $8 of the fee to the department:
2525 (A) together with the application within the time
2626 prescribed by Section 501.023; or
2727 (B) if the fee is deposited in an
2828 interest-bearing account or certificate in the county depository or
2929 invested in an investment authorized by Subchapter A, Chapter 2256,
3030 Government Code, not later than the 35th day after the date on which
3131 the fee is received; and
3232 (3) the following amount to the comptroller at the
3333 time and in the manner prescribed by the comptroller:
3434 (A) $20 of the fee if the applicant's residence
3535 is a county located within a nonattainment area as defined under
3636 Section 107(d) of the federal Clean Air Act (42 U.S.C. Section
3737 7407), as amended, or is an affected county, as defined by Section
3838 386.001, Health and Safety Code; or
3939 (B) $15 of the fee if the applicant's residence
4040 is any other county.
4141 SECTION 2. The change in law made by this Act applies only
4242 to the fee for an application for title that is filed on or after the
4343 effective date of this Act. The fee for an application for title
4444 that is filed before the effective date of this Act is governed by
4545 the law in effect on the date the application was filed, and the
4646 former law is continued in effect for that purpose.
4747 SECTION 3. This Act takes effect September 1, 2021.
