5 | 10 | | WHEREAS, The Texas Legislature for each of the last 19 |

6 | 11 | | regular sessions has adopted a concurrent resolution authorizing |

7 | 12 | | the creation and appointment of joint legislative study committees |
---|
8 | 13 | | by the lieutenant governor and speaker of the house of |
---|
9 | 14 | | representatives; and |
---|
10 | 15 | | WHEREAS, Renewal of the prior authorizations to the presiding |
---|
11 | 16 | | officers enables the legislature to address and study issues that |
---|
12 | 17 | | remain unresolved on sine die adjournment or that emerge subsequent |
---|
13 | 18 | | to that time; and |
---|
14 | 19 | | WHEREAS, It is also desirable to adopt by resolution various |
---|
15 | 20 | | rules and policies regarding the operation of joint committees to |
---|
16 | 21 | | supplement, and reconcile differences between, the senate and house |
---|
17 | 22 | | rules of procedure; now, therefore, be it |
---|
18 | 23 | | RESOLVED, That the 87th Legislature of the State of Texas |
---|
19 | 24 | | hereby authorize the lieutenant governor and speaker of the house |
---|
20 | 25 | | of representatives to create by mutual agreement such joint |
---|
21 | 26 | | committees as they consider necessary during the term of this |
---|
22 | 27 | | legislature; and, be it further |
---|
23 | 28 | | RESOLVED, That each joint committee created pursuant to this |
---|
24 | 29 | | resolution be composed of such combination of legislators, state |
---|
25 | 30 | | officials, or citizen members as shall be determined mutually by |
---|
26 | 31 | | the presiding officers of each house; and, be it further |
---|
27 | 32 | | RESOLVED, That on the request of the presiding officers, the |
---|
28 | 33 | | governor may appoint members to a joint committee created pursuant |
---|
29 | 34 | | to this resolution; and, be it further |
---|
30 | 35 | | RESOLVED, That the presiding officers issue for each |
---|
31 | 36 | | committee so created a joint proclamation identifying the issue or |
---|
32 | 37 | | issues to be studied and listing the committee membership or |
---|
33 | 38 | | describing the committee composition and that the proclamation be |
---|
34 | 39 | | filed with the secretary of the senate and the chief clerk of the |
---|
35 | 40 | | house of representatives; and, be it further |
---|
36 | 41 | | RESOLVED, That the presiding officers designate jointly a |
---|
37 | 42 | | chair, or designate alternatively two co-chairs, from among the |
---|
38 | 43 | | committee membership; and, be it further |
---|
39 | 44 | | RESOLVED, That the chair or co-chairs, acting jointly and |
---|
40 | 45 | | within four weeks of the proclamation, prepare and present to the |
---|
41 | 46 | | presiding officers a proposal for budget and staffing; and, be it |

43 | 48 | | RESOLVED, That the chair or co-chairs be directed to use to |

44 | 49 | | the greatest extent possible the existing staff and administrative |
---|
45 | 50 | | resources of committee members, standing committees, officers of |

46 | 51 | | the senate and house, and legislative service agencies; and, be it |

48 | 53 | | RESOLVED, That the presiding officers jointly review each |
---|
49 | 54 | | budget and staffing proposal, adopt budgetary and staffing |
---|
50 | 55 | | allocations, and determine the manner in which each joint committee |

51 | 56 | | is to be funded; and, be it further |

52 | 57 | | RESOLVED, That the joint committee chair, or the co-chairs |

53 | 58 | | acting by mutual agreement, have authority to create and appoint |
---|
54 | 59 | | subcommittees or affiliated advisory panels and to designate |
---|
55 | 60 | | respective chairs for each, contingent on the advance approval of |
---|
56 | 61 | | the presiding officers for the creation and appointment of |

57 | 62 | | subcommittees or advisory panels containing membership external to |

58 | 63 | | the committee; and, be it further |

59 | 64 | | RESOLVED, That each joint committee, and its subcommittees |

61 | 66 | | provided that no joint committee, nor its subcommittees or advisory |

62 | 67 | | panels, shall convene in a public hearing or other meeting for the |
---|
63 | 68 | | transaction of business unless public notice has been posted by its |
---|
64 | 69 | | chair or co-chairs at the locations specified by the senate and |
---|
65 | 70 | | house rules of procedure for posting of notice of standing |
---|
66 | 71 | | committee meetings at least five calendar days in advance of the |

67 | 72 | | hearing or meeting; and, be it further |

68 | 73 | | RESOLVED, That the preceding clause be construed, for |

69 | 74 | | purposes of Section 551.046, Government Code, as a joint rule of the |
---|
70 | 75 | | senate and house of representatives controlling the posting of |
---|
71 | 76 | | notice for joint committees, and their subcommittees and advisory |
---|
72 | 77 | | panels, in lieu of required posting with the secretary of state; |

74 | 79 | | RESOLVED, That each joint committee have authority to issue |

75 | 80 | | process as provided in Sections 301.024-301.027, Government Code, |

76 | 81 | | provided that any motion for the issuance of process must receive |

77 | 82 | | the record vote of at least two-thirds of those present and voting, |
---|

79 | 84 | | RESOLVED, That each joint committee be entitled to accept |

80 | 85 | | grants and donations as provided by Sections 301.032(b) and (c), |

81 | 86 | | Government Code, and that, on expiration of a joint committee, any |

82 | 87 | | unexpended funds remaining from a grant or donation be transferred |

83 | 88 | | in equal proportions to the accounts of the senate and house of |
