|---|
| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Section 7a to read as follows: |
|---|
| 13 | 13 | | Sec. 7a. (a) A person may not serve more than 12 |
|---|
| 14 | 14 | | consecutive years as a member of the house of representatives. |
|---|
| 15 | 15 | | (b) A person may not serve more than 12 consecutive years as |
|---|
| 16 | 16 | | a member of the senate. |
|---|
| 17 | 17 | | (c) A person is not eligible to be elected to office if the |
|---|
| 18 | 18 | | person's service during the term of office would violate Subsection |
|---|
| 19 | 19 | | (a) or (b) of this section. |
|---|
| 20 | 20 | | (d) The limitation provided by Subsection (a) of this |
|---|
| 21 | 21 | | section applies to consecutive service in the same elective office. |
|---|
| 22 | 22 | | Service in more than one elective office is not added together for |
|---|
| 23 | 23 | | purposes of Subsection (a) of this section. |
|---|
| 24 | 24 | | (e) Legislative service before the legislature convenes in |
|---|
| 25 | 25 | | regular session in 2023 is not counted in determining whether a |
|---|
| 26 | 26 | | person is disqualified from office under this section. This |
|---|
| 27 | 27 | | subsection expires January 1, 2036. |
|---|
| 28 | 28 | | SECTION 2. Article IV, Texas Constitution, is amended by |
|---|
| 29 | 29 | | adding Section 2a to read as follows: |
|---|
| 30 | 30 | | Sec. 2a. (a) A person may not serve more than 12 |
|---|
| 31 | 31 | | consecutive years in an elective office listed in Section 1 of this |
|---|
| 32 | 32 | | article or any other state office elected by the voters at a |
|---|
| 33 | 33 | | statewide election, other than a judicial office. |
|---|
| 34 | 34 | | (b) A person is not eligible to be elected to office if the |
|---|
| 35 | 35 | | person's service during the term of office would violate Subsection |
|---|
| 36 | 36 | | (a) of this section. |
|---|
| 37 | 37 | | (c) The limitation provided by Subsection (a) of this |
|---|
| 38 | 38 | | section applies to consecutive service in the same elective office. |
|---|
| 39 | 39 | | Service in more than one elective office is not added together for |
|---|
| 40 | 40 | | purposes of Subsection (a) of this section. |
|---|
| 41 | 41 | | (d) Nothing in this section prohibits a person from |
|---|
| 42 | 42 | | continuing to serve in an office covered by this section after the |
|---|
| 43 | 43 | | end of a term as a holdover under Section 17, Article XVI, of this |
|---|
| 44 | 44 | | constitution until a successor is qualified. |
|---|
| 45 | 45 | | (e) Service in office before January 17, 2023, does not |
|---|
| 46 | 46 | | count for purposes of determining whether a person is disqualified |
|---|
| 47 | 47 | | from office under this section. This subsection expires January 1, |
|---|
| 48 | 48 | | 2032. |
|---|
| 49 | 49 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 50 | 50 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 51 | 51 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 52 | 52 | | following proposition: "The constitutional amendment to limit the |
|---|
| 53 | 53 | | time that a person may serve as a member of the Texas Legislature or |
|---|
| 54 | 54 | | as a statewide elected officer in the executive branch to 12 |
|---|
| 55 | 55 | | consecutive years." |
