55 A JOINT RESOLUTION
66 proposing a constitutional amendment to limit the time that a
77 person may serve as a member of the Texas Legislature or as a
88 statewide elected officer in the executive branch to 12 consecutive
99 years.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article III, Texas Constitution, is amended by
1212 adding Section 7a to read as follows:
1313 Sec. 7a. (a) A person may not serve more than 12
1414 consecutive years as a member of the house of representatives.
1515 (b) A person may not serve more than 12 consecutive years as
1616 a member of the senate.
1717 (c) A person is not eligible to be elected to office if the
1818 person's service during the term of office would violate Subsection
1919 (a) or (b) of this section.
2020 (d) The limitation provided by Subsection (a) of this
2121 section applies to consecutive service in the same elective office.
2222 Service in more than one elective office is not added together for
2323 purposes of Subsection (a) of this section.
2424 (e) Legislative service before the legislature convenes in
2525 regular session in 2023 is not counted in determining whether a
2626 person is disqualified from office under this section. This
2727 subsection expires January 1, 2036.
2828 SECTION 2. Article IV, Texas Constitution, is amended by
2929 adding Section 2a to read as follows:
3030 Sec. 2a. (a) A person may not serve more than 12
3131 consecutive years in an elective office listed in Section 1 of this
3232 article or any other state office elected by the voters at a
3333 statewide election, other than a judicial office.
3434 (b) A person is not eligible to be elected to office if the
3535 person's service during the term of office would violate Subsection
3636 (a) of this section.
3737 (c) The limitation provided by Subsection (a) of this
3838 section applies to consecutive service in the same elective office.
3939 Service in more than one elective office is not added together for
4040 purposes of Subsection (a) of this section.
4141 (d) Nothing in this section prohibits a person from
4242 continuing to serve in an office covered by this section after the
4343 end of a term as a holdover under Section 17, Article XVI, of this
4444 constitution until a successor is qualified.
4545 (e) Service in office before January 17, 2023, does not
4646 count for purposes of determining whether a person is disqualified
4747 from office under this section. This subsection expires January 1,
4848 2032.
4949 SECTION 3. This proposed constitutional amendment shall be
5050 submitted to the voters at an election to be held November 2, 2021.
5151 The ballot shall be printed to provide for voting for or against the
5252 following proposition: "The constitutional amendment to limit the
5353 time that a person may serve as a member of the Texas Legislature or
5454 as a statewide elected officer in the executive branch to 12
5555 consecutive years."
