55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing a student member
77 of the board of regents of a public institution of higher education
88 or public university system to serve a term that differs from the
99 terms served by the other members of the board.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 30a, Article XVI, Texas Constitution, is
1212 amended to read as follows:
1313 Sec. 30a. (a) The Legislature may provide by law that the
1414 governing boards of public institutions of higher education or
1515 public university systems [Board of Regents of the State
1616 University] and boards of trustees or managers of the other
1717 educational, eleemosynary, and penal institutions of the State, and
1818 such boards as have been, or may hereafter be established by law,
1919 may be composed of an odd number of three or more members who serve
2020 for a term of six (6) years, with one-third, or as near as one-third
2121 as possible, of the members of such boards to be elected or
2222 appointed every two (2) years in such manner as the Legislature may
2323 determine; vacancies in such offices to be filled as may be provided
2424 by law, and the Legislature shall enact suitable laws to give effect
2525 to this section.
2626 (b) The Legislature may provide by law that a board required
2727 by this constitution be composed of members of any number divisible
2828 by three (3) who serve for a term of six (6) years, with one-third of
2929 the members elected or appointed every two (2) years.
3030 (c) Notwithstanding Subsections (a) and (b) of this
3131 section, the Legislature may provide that a position on the
3232 governing board of a public institution of higher education or
3333 public university system that by law must be held by a student of
3434 the institution or system at the time of appointment may have a term
3535 that is shorter than the terms of the other members of the board.
3636 SECTION 2. This proposed constitutional amendment shall be
3737 submitted to the voters at an election to be held November 2, 2021.
3838 The ballot shall be printed to provide for voting for or against the
3939 proposition: "The constitutional amendment authorizing a student
4040 member of the board of regents of a public institution of higher
4141 education or public university system to serve a shorter term than
4242 the six-year terms served by the other members of the board."
