|---|
| 9 | 9 | | terms served by the other members of the board. |
|---|
| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 30a, Article XVI, Texas Constitution, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 30a. (a) The Legislature may provide by law that the |
|---|
| 14 | 14 | | governing boards of public institutions of higher education or |
|---|
| 15 | 15 | | public university systems [Board of Regents of the State |
|---|
| 16 | 16 | | University] and boards of trustees or managers of the other |
|---|
| 17 | 17 | | educational, eleemosynary, and penal institutions of the State, and |
|---|
| 18 | 18 | | such boards as have been, or may hereafter be established by law, |
|---|
| 19 | 19 | | may be composed of an odd number of three or more members who serve |
|---|
| 20 | 20 | | for a term of six (6) years, with one-third, or as near as one-third |
|---|
| 21 | 21 | | as possible, of the members of such boards to be elected or |
|---|
| 22 | 22 | | appointed every two (2) years in such manner as the Legislature may |
|---|
| 23 | 23 | | determine; vacancies in such offices to be filled as may be provided |
|---|
| 24 | 24 | | by law, and the Legislature shall enact suitable laws to give effect |
|---|
| 25 | 25 | | to this section. |
|---|
| 26 | 26 | | (b) The Legislature may provide by law that a board required |
|---|
| 27 | 27 | | by this constitution be composed of members of any number divisible |
|---|
| 28 | 28 | | by three (3) who serve for a term of six (6) years, with one-third of |
|---|
| 29 | 29 | | the members elected or appointed every two (2) years. |
|---|
| 30 | 30 | | (c) Notwithstanding Subsections (a) and (b) of this |
|---|
| 31 | 31 | | section, the Legislature may provide that a position on the |
|---|
| 32 | 32 | | governing board of a public institution of higher education or |
|---|
| 33 | 33 | | public university system that by law must be held by a student of |
|---|
| 34 | 34 | | the institution or system at the time of appointment may have a term |
|---|
| 35 | 35 | | that is shorter than the terms of the other members of the board. |
|---|
| 36 | 36 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 37 | 37 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 38 | 38 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 39 | 39 | | proposition: "The constitutional amendment authorizing a student |
|---|
| 40 | 40 | | member of the board of regents of a public institution of higher |
|---|
| 41 | 41 | | education or public university system to serve a shorter term than |
|---|
| 42 | 42 | | the six-year terms served by the other members of the board." |
