55 A JOINT RESOLUTION
66 proposing a constitutional amendment prohibiting the state from
77 expanding eligibility for Medicaid under the federal Patient
88 Protection and Affordable Care Act.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 51-a, Article III, Texas Constitution,
1111 is amended by adding Subsection (b-1) to read as follows:
1212 (b-1) Notwithstanding Subsection (b) of this section, the
1313 state may not provide medical assistance to any person who became
1414 newly eligible for that assistance under the Patient Protection and
1515 Affordable Care Act (Pub. L. No. 111-148), as amended by the Health
1616 Care and Education Reconciliation Act of 2010 (Pub. L.
1717 No. 111-152), but would not be eligible for that assistance under
1818 the eligibility criteria in effect in this state on January 1, 2021.
1919 SECTION 2. This proposed constitutional amendment shall be
2020 submitted to the voters at an election to be held November 2, 2021.
2121 The ballot shall be printed to provide for voting for or against the
2222 proposition: "The constitutional amendment prohibiting the state
2323 from expanding eligibility for Medicaid under the federal Patient
2424 Protection and Affordable Care Act."
