9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 51-a, Article III, Texas Constitution, | |
11 | 11 | is amended by adding Subsection (b-1) to read as follows: | |
12 | 12 | (b-1) Notwithstanding Subsection (b) of this section, the | |
13 | 13 | state may not provide medical assistance to any person who became | |
14 | 14 | newly eligible for that assistance under the Patient Protection and | |
15 | 15 | Affordable Care Act (Pub. L. No. 111-148), as amended by the Health | |
16 | 16 | Care and Education Reconciliation Act of 2010 (Pub. L. | |
17 | 17 | No. 111-152), but would not be eligible for that assistance under | |
18 | 18 | the eligibility criteria in effect in this state on January 1, 2021. | |
19 | 19 | SECTION 2. This proposed constitutional amendment shall be | |
20 | 20 | submitted to the voters at an election to be held November 2, 2021. | |
21 | 21 | The ballot shall be printed to provide for voting for or against the | |
22 | 22 | proposition: "The constitutional amendment prohibiting the state | |
23 | 23 | from expanding eligibility for Medicaid under the federal Patient | |
24 | 24 | Protection and Affordable Care Act." |
