55 A JOINT RESOLUTION
66 proposing a constitutional amendment to restrict the power of the
77 legislature to mandate requirements on a municipality or county.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article III, Texas Constitution, is amended by
1010 adding Section 68 to read as follows:
1111 Sec. 68. A law enacted by the legislature on or after
1212 January 1, 2022, that requires a municipality or county to
1313 establish, expand, or modify a duty or activity that requires the
1414 expenditure of revenue by the municipality or county is not
1515 effective unless the legislature appropriates or otherwise
1616 provides, from a source other than the revenue of the municipality
1717 or county, for the payment or reimbursement of the costs incurred
1818 for the biennium by the municipality or county in complying with the
1919 requirement.
2020 SECTION 2. This proposed constitutional amendment shall be
2121 submitted to the voters at an election to be held November 2, 2021.
2222 The ballot shall be printed to permit voting for or against the
2323 proposition: "The constitutional amendment to restrict the power
2424 of the legislature to mandate unfunded requirements on a
2525 municipality or county."
