8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article III, Texas Constitution, is amended by | |
10 | 10 | adding Section 68 to read as follows: | |
11 | 11 | Sec. 68. A law enacted by the legislature on or after | |
12 | 12 | January 1, 2022, that requires a municipality or county to | |
13 | 13 | establish, expand, or modify a duty or activity that requires the | |
14 | 14 | expenditure of revenue by the municipality or county is not | |
15 | 15 | effective unless the legislature appropriates or otherwise | |
16 | 16 | provides, from a source other than the revenue of the municipality | |
17 | 17 | or county, for the payment or reimbursement of the costs incurred | |
18 | 18 | for the biennium by the municipality or county in complying with the | |
19 | 19 | requirement. | |
20 | 20 | SECTION 2. This proposed constitutional amendment shall be | |
21 | 21 | submitted to the voters at an election to be held November 2, 2021. | |
22 | 22 | The ballot shall be printed to permit voting for or against the | |
23 | 23 | proposition: "The constitutional amendment to restrict the power | |
24 | 24 | of the legislature to mandate unfunded requirements on a | |
25 | 25 | municipality or county." |
