55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing local option
77 elections to legalize or prohibit the operation of eight-liners or
88 similar gaming devices; authorizing a fee.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 47, Article III, Texas Constitution, is
1111 amended by amending Subsection (a) and adding Subsection (f) to
1212 read as follows:
1313 (a) The Legislature shall pass laws prohibiting lotteries
1414 and gift enterprises in this State other than those authorized by
1515 Subsections (b), (d), (d-1), [and] (e), and (f) of this section.
1616 (f) The Legislature by law may authorize and regulate the
1717 operation of gaming devices commonly known as eight-liners or
1818 similar gaming devices. A law enacted under this subsection must
1919 allow the qualified voters voting at an election in any county,
2020 justice precinct, or municipality to determine by majority vote
2121 whether the gaming devices may be legally operated or prohibited in
2222 the county, justice precinct, or municipality. The Legislature may
2323 impose a fee on the gaming devices approved by a majority of the
2424 voters or authorize a political subdivision to impose a fee on the
2525 gaming devices. The Legislature may determine the rate of the fee
2626 and the allocation of the revenue from the fee notwithstanding any
2727 other provision of this Constitution governing the rate or
2828 allocation of occupations taxes.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 2, 2021.
3131 The ballot shall be printed to permit voting for or against the
3232 proposition: "The constitutional amendment authorizing local
3333 option elections to legalize or prohibit the operation of
3434 eight-liners or similar gaming devices."
