| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 47, Article III, Texas Constitution, is |
|---|
| 11 | 11 | | amended by amending Subsection (a) and adding Subsection (f) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) The Legislature shall pass laws prohibiting lotteries |
|---|
| 14 | 14 | | and gift enterprises in this State other than those authorized by |
|---|
| 15 | 15 | | Subsections (b), (d), (d-1), [and] (e), and (f) of this section. |
|---|
| 16 | 16 | | (f) The Legislature by law may authorize and regulate the |
|---|
| 17 | 17 | | operation of gaming devices commonly known as eight-liners or |
|---|
| 18 | 18 | | similar gaming devices. A law enacted under this subsection must |
|---|
| 19 | 19 | | allow the qualified voters voting at an election in any county, |
|---|
| 20 | 20 | | justice precinct, or municipality to determine by majority vote |
|---|
| 21 | 21 | | whether the gaming devices may be legally operated or prohibited in |
|---|
| 22 | 22 | | the county, justice precinct, or municipality. The Legislature may |
|---|
| 23 | 23 | | impose a fee on the gaming devices approved by a majority of the |
|---|
| 24 | 24 | | voters or authorize a political subdivision to impose a fee on the |
|---|
| 25 | 25 | | gaming devices. The Legislature may determine the rate of the fee |
|---|
| 26 | 26 | | and the allocation of the revenue from the fee notwithstanding any |
|---|
| 27 | 27 | | other provision of this Constitution governing the rate or |
|---|
| 28 | 28 | | allocation of occupations taxes. |
|---|
| 29 | 29 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 30 | 30 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 31 | 31 | | The ballot shall be printed to permit voting for or against the |
|---|
| 32 | 32 | | proposition: "The constitutional amendment authorizing local |
|---|
| 33 | 33 | | option elections to legalize or prohibit the operation of |
|---|
| 34 | 34 | | eight-liners or similar gaming devices." |
