| 6 | 6 | | proposing a constitutional amendment regarding the dedication by |

| 7 | 7 | | general law of revenue of or money received by this state and money |
|---|
| 8 | 8 | | held in or deposited to an account or fund inside or outside the |
|---|
| 9 | 9 | | state treasury and the authorized expenditure or appropriation of |
|---|
| 10 | 10 | | revenue or money dedicated by general law. |
|---|
| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article VIII, Texas Constitution, is amended by |
|---|
| 13 | 13 | | adding Section 25 to read as follows: |
|---|
| 14 | 14 | | Sec. 25. (a) The legislature by general law may dedicate |
|---|
| 15 | 15 | | to one or more particular purposes the appropriation or expenditure |
|---|
| 16 | 16 | | of: |
|---|
| 17 | 17 | | (1) revenue of, or money received by, this state from |
|---|
| 18 | 18 | | one or more particular sources; or |
|---|
| 19 | 19 | | (2) money held in or deposited to an identified |
|---|
| 20 | 20 | | account or fund inside or outside the state treasury. |
|---|
| 21 | 21 | | (b) Subsection (a) of this section does not authorize a |
|---|
| 22 | 22 | | dedication by general law of revenue or money otherwise dedicated |
|---|
| 23 | 23 | | by this constitution in a manner that is inconsistent with that |
|---|
| 24 | 24 | | constitutional dedication. |
|---|
| 25 | 25 | | (c) Revenue or money the appropriation or expenditure of |
|---|
| 26 | 26 | | which is dedicated by general law to a purpose or purposes as |
|---|
| 27 | 27 | | described by Subsection (a) of this section may not be appropriated |
|---|
| 28 | 28 | | or expended for any purpose other than the dedicated purpose or |
|---|
| 29 | 29 | | purposes, except as authorized by a subsequently adopted general |
|---|
| 30 | 30 | | law that: |
|---|
| 31 | 31 | | (1) expressly amends or repeals the general law under |
|---|
| 32 | 32 | | which the revenue or money was dedicated; and |
|---|
| 33 | 33 | | (2) is adopted by a record vote of two-thirds of the |
|---|
| 34 | 34 | | membership of both houses of the legislature. |
|---|
| 35 | 35 | | SECTION 2. The following temporary provision is added to |
|---|
| 36 | 36 | | the Texas Constitution: |
|---|
| 37 | 37 | | TEMPORARY PROVISION. (a) This temporary provision applies |
|---|
| 38 | 38 | | to the constitutional amendment proposed by the 87th Legislature, |
|---|
| 39 | 39 | | Regular Session, 2021, regarding the dedication by general law of |
|---|
| 40 | 40 | | revenue of or money received by this state and money held in or |
|---|
| 41 | 41 | | deposited to an account or fund inside or outside the state treasury |
|---|
| 42 | 42 | | and the authorized expenditure or appropriation of revenue or money |
|---|
| 43 | 43 | | dedicated by general law. |
|---|
| 44 | 44 | | (b) Section 25, Article VIII, of this constitution takes |
|---|
| 45 | 45 | | effect September 1, 2023, and applies only to appropriations |
|---|
| 46 | 46 | | authorized for or expenditures during a state fiscal year beginning |
|---|
| 47 | 47 | | on or after that date. |
|---|
| 48 | 48 | | (c) This temporary provision expires January 1, 2024. |
|---|
| 49 | 49 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 50 | 50 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 51 | 51 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 52 | 52 | | proposition: "The constitutional amendment regarding the |
|---|
| 53 | 53 | | dedication by general law of revenue of or money received by this |
|---|
| 54 | 54 | | state and money held in or deposited to an account or fund inside or |
|---|
| 55 | 55 | | outside the state treasury and the authorized expenditure or |
|---|
| 56 | 56 | | appropriation of revenue or money dedicated by general law." |
