| 10 | 10 | SECTION 1. Section 17(b), Article I, Texas Constitution, is | |

| 12 | 12 | (b) In this section, "public use" does not include the | |
| 13 | 13 | taking of property under Subsection (a) of this section for | |
| 14 | 14 | transfer to a private entity [for the primary purpose of economic | |
| 15 | 15 | development or enhancement of tax revenues]. | |
| 16 | 16 | SECTION 2. This proposed constitutional amendment shall be | |
| 17 | 17 | submitted to the voters at an election to be held November 2, 2021. | |
| 18 | 18 | The ballot shall be printed to permit voting for or against the | |
| 19 | 19 | proposition: "The constitutional amendment prohibiting the taking | |
| 20 | 20 | of property by eminent domain for the purpose of transferring the | |
| 21 | 21 | property to a private entity." |
