| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article XVI, Texas Constitution, is amended by |
|---|
| 10 | 10 | | adding Section 74 to read as follows: |
|---|
| 11 | 11 | | Sec. 74. (a) This state, if authorized by federal law, |
|---|
| 12 | 12 | | shall observe daylight saving time year-round throughout the state. |
|---|
| 13 | 13 | | (b) This section applies to all portions of the state, |
|---|
| 14 | 14 | | regardless of time zone. |
|---|
| 15 | 15 | | (c) Subsections (a) and (b) of this section apply only if |
|---|
| 16 | 16 | | the United States Congress enacts legislation that becomes law that |
|---|
| 17 | 17 | | authorizes this state to observe daylight saving time as prescribed |
|---|
| 18 | 18 | | by this section. If such federal legislation becomes law, |
|---|
| 19 | 19 | | Subsections (a) and (b) of this section apply beginning on the first |
|---|
| 20 | 20 | | date, after the date that federal law takes effect, on which this |
|---|
| 21 | 21 | | state would otherwise have switched from observing daylight saving |
|---|
| 22 | 22 | | time to observing standard time. |

| 23 | 23 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 24 | 24 | | submitted to the voters at an election to be held November 2, 2021. |
|---|
| 25 | 25 | | The ballot shall be printed to permit voting for or against the |
|---|
| 26 | 26 | | proposition: "The constitutional amendment requiring this state to |
|---|
| 27 | 27 | | observe daylight saving time year-round." |
