55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the denial of bail
77 to an accused person if necessary to ensure the person's appearance
88 in court and the safety of the community and of any person,
99 including the victim of the alleged offense.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article I, Texas Constitution, is amended by
1212 adding Section 11d to read as follows:
1313 Sec. 11d. A person may be denied bail pending trial if a
1414 judge or magistrate determines by clear and convincing evidence
1515 that requiring bail and conditions of release is insufficient to
1616 reasonably ensure:
1717 (1) the person's appearance in court as required; or
1818 (2) the safety of the community or of any person,
1919 including the victim of the alleged offense.
2020 SECTION 2. This proposed constitutional amendment shall be
2121 submitted to the voters at an election to be held November 2, 2021.
2222 The ballot shall be printed to permit voting for or against the
2323 proposition: "The constitutional amendment authorizing the denial
2424 of bail to an accused person if necessary to ensure the person's
2525 appearance in court and the safety of the community and of any
2626 person, including the victim of the alleged offense."
