66 relating to the administration of county primary funds.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 173.034 (a), Election Code, is amended
99 to read as follows:
1010 (a) The county chair shall manage the county primary fund.
1111 The county chair shall maintain the county primary fund separately
1212 from other funds managed by the political party.
1313 SECTION 2. Subchapter B, Chapter 173, Election Code, is
1414 amended by adding Section 173.0342 to read as follows:
1515 Sec. 173.0342. REQUIRED AFFIDAVIT FOR COUNTY CHAIR. A
1616 county chair who manages a county primary fund shall execute and
1717 submit an affidavit to the secretary of state stating that the chair
1818 will:
1919 (1) deposit money in the fund and use money in the fund
2020 only in accordance with this chapter;
2121 (2) maintain the fund separately from other funds
2222 managed by the political party; and
2323 (3) not comingle money in the fund with other money
2424 managed by the political party or its officers.
2525 SECTION 3. The secretary of state shall conduct the initial
2626 audits required under Section 173.035(a), Election Code, as amended
2727 by this Act, not later than December 31, 2022. The secretary shall
2828 designate approximately 10 percent of county primary funds as
2929 subject to the initial round of audits and designate 10 percent of
3030 the remaining funds as subject to each of the subsequent nine rounds
3131 of audits.
3232 SECTION 4. This Act takes effect September 1, 2021.
