| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 39.101, Utilities Code, is amended by | |
| 10 | 10 | adding Subsections (b-1) and (b-2) to read as follows: | |
| 11 | 11 | (b-1) A retail electric provider may not enroll a customer | |
| 12 | 12 | in a variable rate plan without the customer's express consent. The | |
| 13 | 13 | consent must be given in a manner that indicates the customer | |
| 14 | 14 | understands that the customer is enrolling in a variable rate plan. | |
| 15 | 15 | The retail electric provider shall provide notice that the plan | |
| 16 | 16 | includes variable rates in an easily readable font and type size. | |
| 17 | 17 | (b-2) A retail electric provider may not offer to a retail | |
| 18 | 18 | customer a rate plan that allows switching from one rate structure | |
| 19 | 19 | to another rate structure. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2021. |
