57 relating to health benefit plan coverage for colorectal cancer
68 early detection.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 1363.001, Insurance Code, is amended to
911 read as follows:
1012 Sec. 1363.001. APPLICABILITY OF CHAPTER. This chapter
1113 applies only to a health benefit plan, including a small employer
1214 health benefit plan written under Chapter 1501 or coverage that is
1315 provided by a health group cooperative under Subchapter B of that
1416 chapter, that:
1517 (1) provides benefits for medical or surgical expenses
1618 incurred as a result of a health condition, accident, or sickness,
1719 including:
1820 (A) an individual, group, blanket, or franchise
1921 insurance policy or insurance agreement, a group hospital service
2022 contract, or an individual or group evidence of coverage that is
2123 offered by:
2224 (i) an insurance company;
2325 (ii) a group hospital service corporation
2426 operating under Chapter 842;
2527 (iii) a fraternal benefit society operating
2628 under Chapter 885;
2729 (iv) a Lloyd's plan operating under Chapter
2830 941;
2931 (v) a stipulated premium company operating
3032 under Chapter 884; [or]
3133 (vi) a health maintenance organization
3234 operating under Chapter 843; or
3335 (vii) a reciprocal or interinsurance
3436 exchange operating under Chapter 942; and
3537 (B) to the extent permitted by the Employee
3638 Retirement Income Security Act of 1974 (29 U.S.C. Section 1001 et
3739 seq.), a health benefit plan that is offered by:
3840 (i) a multiple employer welfare arrangement
3941 as defined by Section 3 of that Act; or
4042 (ii) another analogous benefit
4143 arrangement;
4244 (2) is offered by an approved nonprofit health
4345 corporation operating under Chapter 844; or
4446 (3) provides health and accident coverage through a
4547 risk pool created under Chapter 172, Local Government Code,
4648 notwithstanding Section 172.014, Local Government Code, or any
4749 other law.
4850 SECTION 2. Section 1363.002, Insurance Code, is amended to
4951 read as follows:
5052 Sec. 1363.002. EXCEPTION. This chapter does not apply to:
5153 (1) a plan that provides coverage:
5254 (A) only for a specified disease or other limited
5355 benefit;
5456 (B) only for accidental death or dismemberment;
5557 (C) for wages or payments in lieu of wages for a
5658 period during which an employee is absent from work because of
5759 sickness or injury;
5860 (D) as a supplement to a liability insurance
5961 policy; [or]
6062 (E) only for indemnity for hospital confinement;
6163 or
6264 (F) only for dental or vision care;
6365 (2) [a small employer health benefit plan written
6466 under Chapter 1501;
6567 [(3)] a Medicare supplemental policy as defined by
6668 Section 1882(g)(1), Social Security Act (42 U.S.C. Section 1395ss),
6769 as amended;
6870 (3) a credit-only insurance policy;
6971 (4) a workers' compensation insurance policy;
7072 (5) medical payment insurance coverage provided under
7173 a motor vehicle insurance policy; [or]
7274 (6) a limited benefit policy that does not provide
7375 coverage for physical examinations or wellness exams;
7476 (7) a multiple employer welfare arrangement that holds
7577 a certificate of authority under Chapter 846; or
7678 (8) [(6)] a long-term care policy, including a nursing
7779 home fixed indemnity policy, unless the commissioner determines
7880 that the policy provides benefit coverage so comprehensive that the
7981 policy is a health benefit plan as described by Section 1363.001.
8082 SECTION 3. Section 1363.003, Insurance Code, is amended to
8183 read as follows:
8284 Sec. 1363.003. MINIMUM COVERAGE REQUIRED. (a) A health
8385 benefit plan that provides coverage for screening medical
8486 procedures must provide to each individual enrolled in the plan who
8587 is 45 [50] years of age or older and at normal risk for developing
8688 colon cancer coverage for expenses incurred in conducting a
8789 medically recognized screening examination for the detection of
8890 colorectal cancer.
8991 (b) The minimum coverage required under this section must
9092 include:
9193 (1) all colorectal cancer examinations, preventive
9294 services, and laboratory tests assigned a grade of "A" or "B" by the
9395 United States Preventive Services Task Force for average-risk
9496 individuals, including the services that may be assigned a grade of
9597 "A" or "B" in the future [a fecal occult blood test performed
9698 annually and a flexible sigmoidoscopy performed every five years];
9799 and [or]
98100 (2) an initial colonoscopy or other medical test or
99101 procedure for colorectal cancer screening and a follow-up
100102 colonoscopy if the results of the initial colonoscopy, test, or
101103 procedure are abnormal [a colonoscopy performed every 10 years].
102104 (c) For an enrollee in a managed care plan as defined by
103105 Section 1451.151, the plan may impose a cost-sharing requirement
104106 for coverage described by this section only if the enrollee obtains
105107 the covered benefit or service outside the plan's network.
106108 SECTION 4. The change in law made by this Act applies only
107109 to a health benefit plan that is delivered, issued for delivery, or
108110 renewed on or after January 1, 2022. A health benefit plan that is
109111 delivered, issued for delivery, or renewed before January 1, 2022,
110112 is governed by the law as it existed immediately before the
111113 effective date of this Act, and that law is continued in effect for
112114 that purpose.
113115 SECTION 5. This Act takes effect September 1, 2021.
