55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of emergency care for purposes of
88 certain health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 843.002(7), Insurance Code, is amended
1111 to read as follows:
1212 (7) "Emergency care" means health care services
1313 provided in a hospital emergency facility, freestanding emergency
1414 medical care facility, or comparable emergency facility to evaluate
1515 and stabilize medical conditions of a recent onset and severity,
1616 including severe pain, regardless of the final diagnosis of the
1717 conditions, that would lead a prudent layperson possessing an
1818 average knowledge of medicine and health to believe that the
1919 individual's condition, sickness, or injury is of such a nature
2020 that failure to get immediate medical care could:
2121 (A) place the individual's health in serious
2222 jeopardy;
2323 (B) result in serious impairment to bodily
2424 functions;
2525 (C) result in serious dysfunction of a bodily
2626 organ or part;
2727 (D) result in serious disfigurement; or
2828 (E) for a pregnant woman, result in serious
2929 jeopardy to the health of the fetus.
3030 SECTION 2. Section 1301.155(a), Insurance Code, is amended
3131 to read as follows:
3232 (a) In this section, "emergency care" means health care
3333 services provided in a hospital emergency facility, freestanding
3434 emergency medical care facility, or comparable emergency facility
3535 to evaluate and stabilize a medical condition of a recent onset and
3636 severity, including severe pain, regardless of the final diagnosis
3737 of the condition, that would lead a prudent layperson possessing an
3838 average knowledge of medicine and health to believe that the
3939 person's condition, sickness, or injury is of such a nature that
4040 failure to get immediate medical care could result in:
4141 (1) placing the person's health in serious jeopardy;
4242 (2) serious impairment to bodily functions;
4343 (3) serious dysfunction of a bodily organ or part;
4444 (4) serious disfigurement; or
4545 (5) in the case of a pregnant woman, serious jeopardy
4646 to the health of the fetus.
4747 SECTION 3. Section 4201.002(2), Insurance Code, is amended
4848 to read as follows:
4949 (2) "Emergency care" means health care services
5050 provided in a hospital emergency facility or comparable facility to
5151 evaluate and stabilize medical conditions of a recent onset and
5252 severity, including severe pain, regardless of the final diagnosis
5353 of the conditions, that would lead a prudent layperson possessing
5454 an average knowledge of medicine and health to believe that the
5555 individual's condition, sickness, or injury is of such a nature
5656 that failure to get immediate medical care could:
5757 (A) place the individual's health in serious
5858 jeopardy;
5959 (B) result in serious impairment to bodily
6060 functions;
6161 (C) result in serious dysfunction of a bodily
6262 organ or part;
6363 (D) result in serious disfigurement; or
6464 (E) for a pregnant woman, result in serious
6565 jeopardy to the health of the fetus.
6666 SECTION 4. The changes in law made by this Act apply only to
6767 a health benefit plan delivered, issued for delivery, or renewed on
6868 or after January 1, 2022. A health benefit plan delivered, issued
6969 for delivery, or renewed before January 1, 2022, is governed by the
7070 law as it existed immediately before the effective date of this Act,
7171 and that law is continued in effect for that purpose.
7272 SECTION 5. This Act takes effect September 1, 2021.
