77 relating to the regulation of food production on single-family
88 residential lots by a municipality or property owners' association.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 217, Local Government Code, is amended
1111 by adding Subchapter Z to read as follows:
1212 SUBCHAPTER Z. MISCELLANEOUS PROVISIONS
1313 Sec. 217.901. FOOD PRODUCTION ALLOWED ON SINGLE-FAMILY
1414 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
1515 provided by Subsection (b), a municipality may not adopt or enforce
1616 an ordinance that prohibits any of the following activities on a
1717 single-family residential lot:
1818 (1) the growing of fruits and vegetables; or
1919 (2) the raising or keeping of:
2020 (A) six or fewer domestic fowls;
2121 (B) six or fewer rabbits; or
2222 (C) three or fewer beehives.
2323 (b) A municipality may impose reasonable regulations on the
2424 raising or keeping of fowls, rabbits, or bees on a single-family
2525 residential lot that do not have the effect of prohibiting the
2626 raising or keeping of the fowls, rabbits, or bees, including:
2727 (1) a limit on the number of animals or beehives that
2828 is more than the minimum number allowed by this section;
2929 (2) a prohibition on raising or keeping of a rooster;
3030 or
3131 (3) the minimum distance between an animal shelter or
3232 beehive and a residential structure.
3333 (c) An ordinance adopted by a municipality that violates
3434 this section is void.
3535 SECTION 2. Chapter 202, Property Code, is amended by adding
3636 Section 202.022 to read as follows:
3737 Sec. 202.022. FOOD PRODUCTION ALLOWED ON SINGLE-FAMILY
3838 RESIDENTIAL LOT. (a) Notwithstanding any other law and except as
3939 provided by Subsection (b), a property owners' association may not
4040 adopt or enforce a restrictive covenant that prohibits any of the
4141 following activities on a single-family residential lot:
4242 (1) the growing of fruits and vegetables;
4343 (2) the raising or keeping of:
4444 (A) six or fewer domestic fowls;
4545 (B) six or fewer rabbits; or
4646 (C) three or fewer beehives; or
4747 (3) a cottage food production operation, as defined by
4848 Section 437.001(2-b), Health and Safety Code.
4949 (b) A property owners' association may adopt and enforce a
5050 restrictive covenant imposing reasonable requirements on the
5151 raising or keeping of fowls, rabbits, or bees on a single-family
5252 residential lot that do not have the effect of prohibiting the
5353 raising or keeping of the fowls, rabbits, or bees, including:
5454 (1) a limit on the number of animals or beehives that
5555 is more than the minimum number allowed by this section;
5656 (2) a prohibition on raising or keeping of a rooster;
5757 or
5858 (3) the minimum distance between an animal shelter or
5959 beehive and a residential structure.
6060 (c) A provision that violates this section is void.
6161 SECTION 3. This Act takes effect September 1, 2021.
