66 AN ACT
77 relating to certain rules, policies, or procedures affecting
88 inmates of the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 492, Government Code, is amended by
1111 adding Section 492.018 to read as follows:
1212 Sec. 492.018. ATTORNEY GENERAL OPINION REGARDING RULES,
1313 POLICIES, OR PROCEDURES AFFECTING CONSTITUTIONAL RIGHTS. (a)
1414 Before adopting a rule, policy, or procedure that materially
1515 affects the constitutional rights of a person confined in a
1616 facility operated by or under contract with the department, the
1717 board shall request an opinion from the attorney general on whether
1818 the proposed rule, policy, or procedure is constitutional.
1919 (b) The board may not adopt a proposed rule, policy, or
2020 procedure unless the attorney general opinion states that the rule,
2121 policy, or procedure is constitutional.
2222 (c) The attorney general shall provide to each standing
2323 committee of the legislature having primary jurisdiction over the
2424 department a copy of any opinion provided to the board under this
2525 section.
2626 SECTION 2. This Act takes effect September 1, 2021.
