9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 492, Government Code, is amended by | |
11 | 11 | adding Section 492.018 to read as follows: | |
12 | 12 | Sec. 492.018. ATTORNEY GENERAL OPINION REGARDING RULES, | |
13 | 13 | POLICIES, OR PROCEDURES AFFECTING CONSTITUTIONAL RIGHTS. (a) | |
14 | 14 | Before adopting a rule, policy, or procedure that materially | |
15 | 15 | affects the constitutional rights of a person confined in a | |
16 | 16 | facility operated by or under contract with the department, the | |
17 | 17 | board shall request an opinion from the attorney general on whether | |
18 | 18 | the proposed rule, policy, or procedure is constitutional. | |
19 | 19 | (b) The board may not adopt a proposed rule, policy, or | |
20 | 20 | procedure unless the attorney general opinion states that the rule, | |
21 | 21 | policy, or procedure is constitutional. | |
22 | 22 | (c) The attorney general shall provide to each standing | |
23 | 23 | committee of the legislature having primary jurisdiction over the | |
24 | 24 | department a copy of any opinion provided to the board under this | |
25 | 25 | section. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
