85 AN ACT
96 relating to monthly reports of certain activity of the Department
107 of Family and Protective Services.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 264.017, Family Code, is amended by
1310 adding Subsections (f), (g), and (h) to read as follows:
1411 (f) In addition to the other reports required by this
1512 section, the department shall publish a monthly report containing
1613 the following information for the preceding month:
1714 (1) with respect to statewide intake:
1815 (A) the number of child abuse, neglect, or
1916 exploitation reports received sorted by the source of the report;
2017 (B) the number of child abuse, neglect, or
2118 exploitation reports that met the statutory definition of child
2219 abuse, neglect, or exploitation that were referred for
2320 investigation sorted by the type of allegation and the number of
2421 reports that were confirmed as abuse, neglect, or exploitation
2522 after an investigation;
2623 (C) the average time to process an electronic
2724 report of child abuse, neglect, or exploitation;
2825 (D) the average hold time for calls to the
2926 department's abuse hotline;
3027 (E) the percentage of calls to the department's
3128 abuse hotline that were abandoned before the caller spoke with a
3229 person; and
3330 (F) the number of calls received by the Texas
3431 Youth Helpline regarding runaway youth;
3532 (2) with respect to child protective investigations:
3633 (A) the total number of cases opened;
3734 (B) the total number of cases completed and
3835 closed sorted by the manner in which the case was closed;
3936 (C) the average number of days to close a case;
4037 (D) the total number of cases opened at
4138 residential child-care facilities;
4239 (E) the total percentage of cases assigned the
4340 highest and second highest priorities the investigations of which
4441 were started within the time required by Section 261.301;
4542 (F) the total number of cases for which the
4643 determination was changed after an administrative review within 12
4744 months of the date of the determination; and
4845 (G) the percentage of alleged victims in
4946 investigations that were closed without providing services for
5047 which, within 12 months of the date the case was closed, the
5148 department:
5249 (i) confirmed another allegation of abuse,
5350 neglect, or exploitation against the child; or
5451 (ii) opened another stage for services;
5552 (3) with respect to family-based safety services:
5653 (A) the total number of cases opened;
5754 (B) the total number of cases closed;
5855 (C) the average number of days to close a case;
5956 (D) the percentage of cases in which a child was
6057 eventually removed from the child's home; and
6158 (E) the percentage of cases which were closed
6259 without providing further services for which, within 12 months of
6360 the date the case was closed, the department:
6461 (i) confirmed another allegation of abuse,
6562 neglect, or exploitation against the child; or
6663 (ii) opened another stage for services;
6764 (4) with respect to conservatorship services:
6865 (A) the total number of children removed from
6966 their home;
7067 (B) the total number of children who exited from
7168 the managing conservatorship of the department sorted by the manner
7269 in which the child exited;
7370 (C) the average number of months a child remained
7471 in the managing conservatorship of the department;
7572 (D) the average number of placements a child has
7673 while in the managing conservatorship of the department;
7774 (E) the percentage of sibling groups placed with
7875 the same foster family;
7976 (F) the percentage of youth who have aged out of
8077 foster care and completed the Preparation for Adult Living program;
8178 (G) the percentage of youth who exited from the
8279 managing conservatorship of the department to a permanent
8380 placement;
8481 (H) the percentage of children who are adopted
8582 within 12 months of the date their parent's parental rights were
8683 terminated;
8784 (I) the percentage of children in the managing
8885 conservatorship of the department for longer than two years who
8986 achieve permanency;
9087 (J) the percentage of children who are returned
9188 to their parents and for whom, within 12 months of the date the case
9289 was closed, the department:
9390 (i) confirmed another allegation of abuse,
9491 neglect, or exploitation against the child; or
9592 (ii) opened another stage for services;
9693 (K) the percentage of children in the managing
9794 conservatorship of the department who are placed with a relative
9895 caregiver; and
9996 (L) the percentage of children in foster care
10097 placed in each county in the state;
10198 (5) with respect to residential child-care licensing:
10299 (A) the percentage of investigations in which the
103100 department made a high risk finding;
104101 (B) the percentage of child-care facilities with
105102 no recent violations;
106103 (C) the number of illegal operations identified,
107104 resolved, and pending; and
108105 (D) the number of validated allegations of child
109106 abuse, neglect, or exploitation in child-care facilities; and
110- (6) with respect to parental child safety placement
111- agreements:
112- (A) the number of children placed under a
113- parental child safety placement agreement;
114- (B) the average duration of a placement under a
115- parental child safety placement agreement;
116- (C) the average duration of a placement under a
117- parental child safety placement agreement during an investigation;
118- and
119- (D) the percentage of children removed from a
120- placement under a parental child safety placement agreement and
121- placed in the managing conservatorship of the department.
107+ (6) with respect to staffing in statewide intake,
108+ residential child-care investigations, child protective
109+ investigations, family-based safety services, and conservatorship
110+ services:
111+ (A) the percentage of caseworker turnover;
112+ (B) the total number of caseworkers hired;
113+ (C) the total number of caseworkers terminated;
114+ (D) the average vacancy rate for caseworker
115+ positions; and
116+ (E) the average daily caseloads for caseworkers.
122117 (g) The department shall provide the report required by
123118 Subsection (f) to the legislature and shall publish the report and
124119 make the report available electronically to the public not later
125120 than the 30th day after the end of the month for which the report is
126121 made.
127122 (h) The department may contract with a third party to assist
128123 the department with collecting, analyzing, and reporting the data
129- required under Subsection (f). The third party must:
130- (1) be a Texas-based university;
131- (2) be independent of the department; and
132- (3) have demonstrated expertise in statistical,
133- financial, actuarial, logistical, and operational analysis.

134125 SECTION 2. This Act takes effect September 1, 2021.
