6	6	AN ACT
7	7	relating to the automatic admission of students to general academic
8	8	teaching institutions.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 51.803(a-1), (a-2), and (a-6),
11	11	Education Code, are amended to read as follows:
12	12	(a-1) Beginning with admissions for the 2025-2026
13	13	[2011-2012] academic year, a general academic teaching institution
14	14	[The University of Texas at Austin] is not required to offer
15	15	admission to applicants who qualify for automatic admission under
16	16	Subsection (a) in excess of the number required to fill 30 [75]
17	17	percent of the institution's [university's] enrollment capacity
18	18	designated for first-time resident undergraduate students in an
19	19	academic year. If the number of applicants who qualify for
20	20	automatic admission to the institution [The University of Texas at
21	21	Austin] under Subsection (a) for an academic year exceeds 30 [75]
22	22	percent of the institution's [university's] enrollment capacity
23	23	designated for first-time resident undergraduate students for that
24	24	academic year, the institution [university] may elect to offer
25	25	admission to those applicants as provided by this subsection and
26	26	not as otherwise required by Subsection (a). If the institution
27	27	[university] elects to offer admission under this subsection, the
28	28	institution [university] shall offer admission to those applicants
29	29	by percentile rank according to high school graduating class
30	30	standing based on grade point average, beginning with the top
31	31	percentile rank, until the applicants qualified under Subsection
32	32	(a) have been offered admission in the number estimated in good
33	33	faith by the institution [university] as sufficient to fill 30 [75]
34	34	percent of the institution's [university's] enrollment capacity
35	35	designated for first-time resident undergraduate students, except
36	36	that the institution [university] must offer admission to all
37	37	applicants with the same percentile rank. After the applicants
38	38	qualified for automatic admission under Subsection (a) have been
39	39	offered admission under this subsection in the number estimated in
40	40	good faith as sufficient to fill at least 30 [75] percent of the
41	41	designated enrollment capacity described by this subsection, the
42	42	institution [university] shall consider any remaining applicants
43	43	qualified for automatic admission under Subsection (a) in the same
44	44	manner as other applicants for admission as first-time
45	45	undergraduate students in accordance with Section 51.805.
46	46	(a-2) If the number of applicants who apply to a general
47	47	academic teaching institution during the current academic year for
48	48	admission in the next academic year and who qualify for automatic
49	49	admission to a general academic teaching institution under
50	50	Subsection (a) exceeds 30 [75] percent of the institution's
51	51	enrollment capacity designated for first-time resident
52	52	undergraduate students for that next academic year and the
53	53	institution plans to offer admission under Subsection (a-1) during
54	54	the next school year, the institution shall, in the manner
55	55	prescribed by the Texas Education Agency and not later than
56	56	September 15, provide to each school district, for dissemination of
57	57	the information to high school junior-level students and their
58	58	parents, notice of which percentile ranks of high school
59	59	senior-level students who qualify for automatic admission under
60	60	Subsection (a) are anticipated by the institution to be offered
61	61	admission under Subsection (a-1) during the next school year.
62	62	(a-6) Not later than December 31 of each academic year in
63	63	which a general academic teaching institution [The University of
64	64	Texas at Austin] offers admission under Subsection (a-1), the
65	65	institution [university] shall deliver a written report to the
66	66	governor, the lieutenant governor, and speaker of the house of
67	67	representatives regarding the institution's [university's]
68	68	progress in each of the following matters:
69	69	(1) increasing geographic diversity of the entering
70	70	freshman class;
71	71	(2) counseling and outreach efforts aimed at students
72	72	qualified for automatic admission under this section;
73	73	(3) recruiting Texas residents who graduate from other
74	74	institutions of higher education to the institution's
75	75	[university's] graduate and professional degree programs;
76	76	(4) recruiting students who are members of
77	77	underrepresented demographic segments of the state's population;
78	78	and
79	79	(5) assessing and improving the institution's
80	80	[university's] regional recruitment efforts [centers].
81	81	SECTION 2. The changes in law made by this Act apply
82	82	beginning with admissions to a general academic teaching
83	83	institution for the 2025-2026 academic year. Admissions to a
84	84	general academic teaching institution for an academic period before
85	85	that academic year are governed by the law in effect immediately
86	86	before the effective date of this Act, and the former law is
87	87	continued in effect for that purpose.
88	88	SECTION 3. This Act takes effect September 1, 2023.
