55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to creating a bilingual special education certification to
88 teach students of limited English proficiency with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 21, Education Code, is
1111 amended by adding Section 21.04891 to read as follows:
1212 Sec. 21.04891. BILINGUAL SPECIAL EDUCATION CERTIFICATION.
1313 (a) In this section, "limited English proficiency" has the meaning
1414 assigned by Section 29.052.
1515 (b) To ensure that there are teachers with special training
1616 in providing instruction to students of limited English proficiency
1717 with disabilities, the board shall establish a bilingual special
1818 education certificate.
1919 (c) To be eligible for a certificate established under this
2020 section, a person must:
2121 (1) satisfactorily complete the coursework for that
2222 certificate in an educator preparation program, including a
2323 skills-based course of instruction on providing instruction to
2424 students of limited English proficiency with disabilities, which
2525 must include instruction on:
2626 (A) the foundations of bilingual, multicultural,
2727 and second language special education;
2828 (B) providing culturally responsive
2929 individualized education programs for students of limited English
3030 proficiency with disabilities;
3131 (C) providing assessment for equity and
3232 inclusion of students of limited English proficiency with and
3333 without disabilities;
3434 (D) developing teaching methods to recognize the
3535 intellectual, developmental, and emotional needs of students in
3636 dual language and transitional bilingual education settings;
3737 (E) teaching fundamental academic skills,
3838 including reading, writing, and mathematics, to students of limited
3939 English proficiency; and
4040 (F) creating dynamic and collaborative
4141 partnerships with families and school professionals;
4242 (2) perform satisfactorily on a bilingual special
4343 education certificate examination prescribed by the board; and
4444 (3) satisfy any other requirements prescribed by the
4545 board.
4646 SECTION 2. The State Board for Educator Certification shall
4747 propose rules:
4848 (1) establishing requirements and prescribing an
4949 examination for a bilingual special education certificate as
5050 required by Section 21.04891, Education Code, as added by this Act;
5151 and
5252 (2) establishing standards to govern the approval and
5353 renewal of approval of educator preparation programs for bilingual
5454 special education certification.
5555 SECTION 3. This Act takes effect September 1, 2021.
