57 relating to the creation and administration of the On-The-Ground
68 Conservation Program by the State Soil and Water Conservation
79 Board.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Chapter 201, Agriculture Code, is amended by
1012 adding Subchapter J to read as follows:
1113 SUBCHAPTER J. ON-THE-GROUND CONSERVATION PROGRAM
1214 Sec. 201.351. DEFINITIONS. In this subchapter:
1315 (1) "Priority conservation measure" means a priority
1416 soil and water conservation land improvement measure designated
1517 under Section 201.355.
1618 (2) "Program" means the On-The-Ground Conservation
1719 Program.
1820 (3) "Soil health characteristics" means the physical,
1921 chemical, and biological characteristics of soil for optimal
2022 production, including lower bulk density, good gas exchange, lower
2123 surface temperature during growing season, high cation exchange
2224 capacity, high soil organic matter, and active soil microorganisms.
2325 Sec. 201.352. CREATION OF PROGRAM. The state board may
2426 develop and administer the program to maximize public benefits by
2527 facilitating priority conservation measures and other soil and
2628 water conservation land improvement measures by landowners and
2729 operators in this state.
2830 Sec. 201.353. PROGRAM FUNCTIONS. (a) The state board may
2931 provide through the program:
3032 (1) technical assistance;
3133 (2) cost-share assistance;
3234 (3) direct grants; and
3335 (4) help in obtaining technical assistance,
3436 cost-share assistance, and direct grants from other public or
3537 private sources.
3638 (b) The state board may create rules, forms, and procedures
3739 necessary for the administration of the program.
3840 (c) The state board may:
3941 (1) obtain grants, cost-sharing assistance, or other
4042 forms of funding from other state or federal governmental entities;
4143 (2) coordinate, receive, and use gifts, grants, and
4244 donations from private sources;
4345 (3) work with qualified nonprofit organizations and
4446 universities to provide technical assistance; and
4547 (4) designate one or more conservation districts to
4648 administer the program locally.
4749 Sec. 201.354. PROGRAM COST-SHARE RATES. The state board
4850 may establish cost-share rates for eligible soil and water
4951 conservation land improvement measures under the program.
5052 Sec. 201.355. PRIORITY CONSERVATION MEASURES. (a) The
5153 state board may designate and give priority under the program to
5254 priority conservation measures that maximize public benefits to the
5355 state. Priority conservation measures include measures that:
5456 (1) improve soil health characteristics;
5557 (2) conserve and manage water resources;
5658 (3) prevent and manage flooding;
5759 (4) control invasive and nuisance species;
5860 (5) improve resilience to weather extremes, climate
5961 variability, and natural disasters;
6062 (6) protect and enhance native habitats, including the
6163 protection of endangered species;
6264 (7) mitigate and reduce soil erosion;
6365 (8) restore land damaged by development; and
6466 (9) sequester carbon to provide environmental
6567 benefits.
6668 (b) The state board may:
6769 (1) establish standards and specifications for each
6870 priority conservation measure designated under this section; and
6971 (2) consider local priorities and needs in designating
7072 a priority conservation measure under this section.
7173 Sec. 201.356. CERTIFICATION. The state board may provide
7274 certification that specific soil and water conservation land
7375 improvement measures have been implemented in accordance with any
7476 standards and specifications established under Section 201.355(b).
7577 Sec. 201.357. REPORT. The state board shall include
7678 information regarding the program's activities in the annual report
7779 required by Section 201.028.
7880 SECTION 2. This Act takes effect September 1, 2021.
