| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 437.212(f), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (f) A member of the state military forces who is not a |
|---|
| 13 | 13 | | full-time or part-time state employee and who has been on state |
|---|
| 14 | 14 | | active duty or on state training or other duty for more than 60 |
|---|
| 15 | 15 | | consecutive days is, notwithstanding Section 1551.1055, Insurance |
|---|
| 16 | 16 | | Code, eligible to participate in the state group benefits program |
|---|
| 17 | 17 | | under Chapter 1551, Insurance Code, and is considered to be a |
|---|
| 18 | 18 | | full-time state employee for the purposes of that chapter, |
|---|
| 19 | 19 | | including the receipt of a full state contribution for insurance |
|---|
| 20 | 20 | | coverage, subject to Subsection (f-1) and the following |
|---|
| 21 | 21 | | requirements: |
|---|
| 22 | 22 | | (1) the participant must be a member of the state |
|---|
| 23 | 23 | | military forces at the time of enrollment in the group benefits |
|---|
| 24 | 24 | | program; and |
|---|
| 25 | 25 | | (2) an application under this subsection for insurance |
|---|
| 26 | 26 | | coverage must be submitted in accordance with procedures |
|---|
| 27 | 27 | | established by the Employees Retirement System of Texas. |
|---|
| 28 | 28 | | SECTION 2. Section 437.212(f), Government Code, as amended |
|---|
| 29 | 29 | | by this Act, applies only to an application for insurance coverage |
|---|
| 30 | 30 | | submitted on or after the effective date of this Act. An application |
|---|
| 31 | 31 | | submitted before that date is governed by the law in effect when the |
|---|
| 32 | 32 | | application was submitted, and the former law is continued in |
|---|
| 33 | 33 | | effect for that purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2021. |
