55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain members of the state
88 military forces to participate in the state group benefits program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 437.212(f), Government Code, is amended
1111 to read as follows:
1212 (f) A member of the state military forces who is not a
1313 full-time or part-time state employee and who has been on state
1414 active duty or on state training or other duty for more than 60
1515 consecutive days is, notwithstanding Section 1551.1055, Insurance
1616 Code, eligible to participate in the state group benefits program
1717 under Chapter 1551, Insurance Code, and is considered to be a
1818 full-time state employee for the purposes of that chapter,
1919 including the receipt of a full state contribution for insurance
2020 coverage, subject to Subsection (f-1) and the following
2121 requirements:
2222 (1) the participant must be a member of the state
2323 military forces at the time of enrollment in the group benefits
2424 program; and
2525 (2) an application under this subsection for insurance
2626 coverage must be submitted in accordance with procedures
2727 established by the Employees Retirement System of Texas.
2828 SECTION 2. Section 437.212(f), Government Code, as amended
2929 by this Act, applies only to an application for insurance coverage
3030 submitted on or after the effective date of this Act. An application
3131 submitted before that date is governed by the law in effect when the
3232 application was submitted, and the former law is continued in
3333 effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2021.
