46 AN ACT
57 relating to implementation of certain health care provider
68 initiatives and measures designed to reduce costs and improve
79 recipient health outcomes under Medicaid.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 531.085, Government Code, is amended to
1012 read as follows:
1113 Sec. 531.085. HOSPITAL EMERGENCY ROOM USE REDUCTION
1214 INITIATIVES. (a) The commission shall develop and implement a
1315 comprehensive plan to reduce the use of hospital emergency room
1416 services by recipients under Medicaid. The plan may include:
1517 (1) a pilot program designed to facilitate program
1618 participants in accessing an appropriate level of health care,
1719 which may include as components:
1820 (A) providing program participants access to
1921 bilingual health services providers; and
2022 (B) giving program participants information on
2123 how to access primary care physicians, advanced practice registered
2224 nurses, and local health clinics;
2325 (2) a pilot program under which health care providers,
2426 other than hospitals, are given financial incentives for treating
2527 recipients outside of normal business hours to divert those
2628 recipients from hospital emergency rooms;
2729 (3) payment of a nominal referral fee to hospital
2830 emergency rooms that perform an initial medical evaluation of a
2931 recipient and subsequently refer the recipient, if medically
3032 stable, to an appropriate level of health care, such as care
3133 provided by a primary care physician, advanced practice registered
3234 nurse, or local clinic;
3335 (4) a program under which the commission or a managed
3436 care organization that enters into a contract with the commission
3537 under Chapter 533 contacts, by telephone or mail, a recipient who
3638 accesses a hospital emergency room three times during a six-month
3739 period and provides the recipient with information on ways the
3840 recipient may secure a medical home to avoid unnecessary treatment
3941 at hospital emergency rooms;
4042 (5) a health care literacy program under which the
4143 commission develops partnerships with other state agencies and
4244 private entities to:
4345 (A) assist the commission in developing
4446 materials that:
4547 (i) contain basic health care information
4648 for parents of young children who are recipients under Medicaid and
4749 who are participating in public or private child-care or
4850 prekindergarten programs, including federal Head Start programs;
4951 and
5052 (ii) are written in a language
5153 understandable to those parents and specifically tailored to be
5254 applicable to the needs of those parents;
5355 (B) distribute the materials developed under
5456 Paragraph (A) to those parents; and
5557 (C) otherwise teach those parents about the
5658 health care needs of their children and ways to address those needs;
5759 and
5860 (6) other initiatives developed and implemented in
5961 other states that have shown success in reducing the incidence of
6062 unnecessary treatment in hospital emergency rooms.
6163 (b) The commission shall coordinate with hospitals and
6264 other providers that receive supplemental payments under the
6365 uncompensated care payment program operated under the Texas Health
6466 Care Transformation and Quality Improvement Program waiver issued
6567 under Section 1115 of the federal Social Security Act (42 U.S.C.
6668 Section 1315) to identify and implement initiatives based on best
6769 practices and models that are designed to reduce Medicaid
6870 recipients' use of hospital emergency room services as a primary
6971 means of receiving health care benefits, including initiatives
7072 designed to improve recipients' access to and use of primary care
7173 providers.
7274 SECTION 2. Subchapter B, Chapter 531, Government Code, is
7375 amended by adding Section 531.0862 to read as follows:
7476 Sec. 531.0862. CONTINUED IMPLEMENTATION OF CERTAIN
7577 INTERVENTIONS AND BEST PRACTICES BY PROVIDERS; BIANNUAL REPORT.
7678 (a) The commission shall encourage Medicaid providers to continue
7779 implementing effective interventions and best practices associated
7880 with improvements in the health outcomes of Medicaid recipients
7981 that were developed and achieved under the Delivery System Reform
8082 Incentive Payment (DSRIP) program previously operated under the
8183 Texas Health Care Transformation and Quality Improvement Program
8284 waiver issued under Section 1115 of the federal Social Security Act
8385 (42 U.S.C. Section 1315), through:
8486 (1) existing provider incentive programs and the
8587 creation of new provider incentive programs;
8688 (2) the terms included in contracts with Medicaid
8789 managed care organizations;
8890 (3) implementation of alternative payment models; or
8991 (4) adoption of other cost-effective measures.
9092 (b) The commission shall biannually prepare and submit a
9193 report to the legislature that contains a summary of the
9294 commission's efforts under this section and Section 531.085(b).
9395 SECTION 3. If before implementing any provision of this Act
9496 a state agency determines that a waiver or authorization from a
9597 federal agency is necessary for implementation of that provision,
9698 the agency affected by the provision shall request the waiver or
9799 authorization and may delay implementing that provision until the
98100 waiver or authorization is granted.
99101 SECTION 4. This Act takes effect September 1, 2021.
