77 relating to the establishment of a border public health response
88 team.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 161, Health and Safety Code, is amended
1111 by adding Subchapter X to read as follows:
1212 SUBCHAPTER X. BORDER PUBLIC HEALTH RESPONSE TEAM
1313 Sec. 161.701. DEFINITIONS. In this subchapter:
1414 (1) "Border county" means a county adjacent to the
1515 international border with Mexico.
1616 (2) "Disaster" has the meaning assigned by Section
1717 418.004, Government Code. The term includes a state of disaster
1818 declared by:
1919 (A) the president of the United States under the
2020 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42
2121 U.S.C. Section 5121 et seq.);
2222 (B) the governor under Section 418.014,
2323 Government Code; or
2424 (C) the presiding officer of the governing body
2525 of a political subdivision under Section 418.108, Government Code.
2626 (3) "Response team" means the border public health
2727 response team established under Section 161.702.
2828 (4) "Sanitarian" has the meaning assigned by Section
2929 1953.001, Occupations Code.
3030 Sec. 161.702. BORDER PUBLIC HEALTH RESPONSE TEAM. The
3131 department shall establish a border public health response team to
3232 deploy in response to public health threats declared by the
3333 commissioner and declared disasters in border counties.
3434 Sec. 161.703. COMPOSITION OF RESPONSE TEAM. The response
3535 team may be composed of the following members appointed by the
3636 commissioner:
3737 (1) an epidemiologist;
3838 (2) a sanitarian;
3939 (3) a nurse;
4040 (4) a public health specialist; and
4141 (5) any other person the commissioner considers
4242 appropriate.
4343 Sec. 161.704. DEPARTMENT DUTIES. (a) The department, in
4444 consultation with the response team, shall, as necessary, enter
4545 into memoranda of understanding with other state agencies to
4646 develop policies, plans, and procedures to facilitate an effective
4747 response to a declared public health threat or disaster.
4848 (b) The department shall provide, or contract to provide,
4949 training, equipment, and support staff to the response team to
5050 enhance the team's response efforts, as appropriate.
5151 Sec. 161.705. RESPONSE TEAM DUTIES. During a declared
5252 public health threat or disaster in a border county, the response
5353 team shall, as appropriate:
5454 (1) assess health infrastructure and response
5555 capabilities for the threat or disaster in a border county;
5656 (2) develop appropriate responses for the threat or
5757 disaster in a border county; and
5858 (3) address language, cultural, and environmental
5959 factors that are unique to responding to the threat or disaster in a
6060 border county.
6161 Sec. 161.706. FUNDING. (a) The department shall
6262 coordinate with the commission, the office of the governor, the
6363 federal government, and any other appropriate entity for funding to
6464 support the response team's activities.
6565 (b) The department may accept on behalf of the response team
6666 a gift, grant, or donation from any source to carry out the purposes
6767 of this subchapter.
6868 SECTION 2. Not later than December 1, 2021, the Department
6969 of State Health Services shall establish the border public health
7070 response team as required by Subchapter X, Chapter 161, Health and
7171 Safety Code, as added by this Act.
7272 SECTION 3. This Act takes effect September 1, 2021.
