97 relating to the transition of case management for children and
108 pregnant women program services and Healthy Texas Women program
119 services to a managed care program.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1412 amended by adding Section 533.002555 to read as follows:
1513 Sec. 533.002555. TRANSITION OF CASE MANAGEMENT FOR CHILDREN
1614 AND PREGNANT WOMEN PROGRAM RECIPIENTS TO MANAGED CARE PROGRAM. (a)
1715 In this section, "children and pregnant women program" means the
1816 benefits program provided under Medicaid and administered by the
1917 Department of State Health Services that provides case management
2018 services to children who have a health condition or health risk and
2119 pregnant women who have a high-risk condition.
2220 (b) The commission shall transition to a Medicaid managed
2321 care model for case management services provided to recipients
2422 under the children and pregnant women program. In transitioning
2523 services under this section, the commission shall ensure a
2624 recipient is provided case management services through the managed
2725 care plan in which the recipient is enrolled.
2826 (c) In implementing this section, the commission shall
2927 ensure:
3028 (1) a seamless transition in case management for
3129 recipients receiving benefits under the children and pregnant women
3230 program; and
3331 (2) case management services provided under the
3432 program are not interrupted.
3533 SECTION 2. Subchapter F, Chapter 32, Health and Safety
3634 Code, is amended by amending Section 32.152 and adding Sections
3735 32.156 and 32.157 to read as follows:
3836 Sec. 32.152. [ASSESSING] PROVISION OF HEALTHY TEXAS WOMEN
39- PROGRAM SERVICES THROUGH MANAGED CARE. (a) The commission shall

4139 [(1) the feasibility and cost-effectiveness of
4240 contracting] with Medicaid managed care organizations to provide
4341 Healthy Texas Women program services [through managed care in one
4442 or more health care service regions in this state if the Healthy
4543 Texas Women Section 1115 Demonstration Waiver is approved; and
4644 [(2) the potential impact of that delivery model on
4745 women receiving services under the program].
48- (b) In implementing this section, the commission shall:
49- (1) consult with the state Medicaid managed care
50- advisory committee before contracting with Medicaid managed care
51- organizations to provide Healthy Texas Women program services under
52- this section;
53- (2) identify barriers that prevent women from
54- obtaining Healthy Texas Women program services and seek
55- opportunities to mitigate those barriers; and
56- (3) designate Healthy Texas Women program service
57- providers as significant traditional providers until at least the
58- third anniversary of the date the commission initially contracts
59- with Medicaid managed care organizations to provide program
60- services. [This section expires September 1, 2021.]

6147 Sec. 32.156. INFORMATION ABOUT AVAILABILITY OF SUBSIDIZED
6248 HEALTH INSURANCE COVERAGE. (a) The commission and each managed
6349 care organization participating in the Healthy Texas Women program
6450 shall provide a written notice containing information about
6551 eligibility requirements for and enrollment in a health benefit
6652 plan for which an enrollee receives a premium subsidy under the
6753 Patient Protection and Affordable Care Act (Pub. L. No. 111-148),
6854 based on family income, to a woman who:
6955 (1) is enrolled in the Healthy Texas Women program;
7056 and
7157 (2) has a household income that is more than 100
7258 percent but not more than 200 percent of the federal poverty level.
7359 (b) The commission, in consultation with the Texas
7460 Department of Insurance, shall develop the form and content of the
7561 notice required under this section. The notice must include:
7662 (1) the latest information written in clear and easily
7763 understood language on available options for obtaining a subsidized
7864 health benefit plan described by Subsection (a); and
7965 (2) resources for receiving assistance applying for
8066 and enrolling in that health benefit plan.
8167 Sec. 32.157. ASSESSING AUTOMATIC ENROLLMENT OF CERTAIN
8268 WOMEN IN MANAGED CARE. (a) Not later than January 1, 2023, the
8369 commission shall assess the feasibility, cost-effectiveness, and
8470 benefits of automatically enrolling in managed care the women who
8571 become pregnant while receiving services through the Healthy Texas
8672 Women program. The assessment must examine whether automatically
8773 enrolling those women leads to the delivery of prenatal care and
8874 services earlier in the women's pregnancies.
8975 (b) This section expires September 1, 2023.
9076 SECTION 3. As soon as practicable after the effective date
9177 of this Act, the executive commissioner of the Health and Human
9278 Services Commission shall adopt rules necessary to implement the
9379 changes in law made by this Act.
9480 SECTION 4. If before implementing any provision of this Act
9581 a state agency determines that a waiver or authorization from a
9682 federal agency is necessary for implementation of that provision,
9783 the agency affected by the provision shall request the waiver or
9884 authorization and may delay implementing that provision until the
9985 waiver or authorization is granted.
10086 SECTION 5. The Health and Human Services Commission is
10187 required to implement a provision of this Act only if the
10288 legislature appropriates money specifically for that purpose. If
10389 the legislature does not appropriate money specifically for that
10490 purpose, the Health and Human Services Commission may, but is not
10591 required to, implement a provision of this Act using other
10692 appropriations available for that purpose.
10793 SECTION 6. This Act takes effect September 1, 2021.
